Chairman Zimmerman stated that he does not totally agree that some of the wetlands need preserving as the)' are already protected by ordinances. Commissioner Shumway stated that in the future, the Con'unission should rev½ew and amend the PUD seciton of City Code for clarification purposes. The Commission proce~ed to review the propos~ findings of fact relating to the rezoning of Trott Brook Ponds to PUD. Jeff Caine of Caine and Associates ,,vas present representing Gerald Bauer and inclicat~ that the findings should ~ amended to indicate a total acreage of 208 and proposed lots at 83. Commissioner Henck'Sksen expressed concern that allowing protected wetlands to satisfy the PUD 20% public/private open space requirement is getting the City back into the previous scenario of accepting swamps to satisfy park dedication requirements. Commissioner Deemer stated that he believes the proposed road alignment in Trott Brook could be made safer by eliminating the need to access the proposed 174th onto Hwy. #47. Motion by Commissioner Bawden and seconded by Chairman Zimmerman to amend the proposed findings of fact by eliminating Item ~t9 indicating that the City is interested in acquiring wetlands on the property for storm water management purposes. Fu:/'~er Discussion: Commissioner Hendriksen stated fi'mt whether or not the su~ect wetlands are in the City's Comprehensive Plan for storm water management should be the deciding factor as to whether or not the City wants to acquire the wetlands. Mark Banwart provided the Commission with a copy of the Comprehensive Plan which indicated that the area wetlands are desired for storm water management purposes. Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, Deemer, Bawden and Shumway. Voting No: Commissioner Terry. Morion by Cornm~ssioner Deemer and seconded by Commissioner La.Due to add Item #13 to the proposed findings of fact indicating that the street layout in the plat was rearranged to protect wetlands on the site. Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, Deemer, Bawden, Shumway and Terry. Voting No: None. Motion by Commissioner Deemer and seconded by Commissioner Shumway to add Item #14 to the proposed findings of fact indicating that the streets proposed in the plat could ~ further rearranged to alleviate a safety problem along Hwy. #47. Motion carried. VolSang Yes: Chaiwnan Zimmerman, Corpm'fissioners Hendriksen, La.Due, Deemer, Bawden, Shumway and TerD'. Voting No: None.
