CASE <br /> <br />REQUEST TO REZONE THE PROPOSED PLAT OF CARR ADDITION <br />FROM R-1 RURAL RESIDENTIAL TO PLANNED UNIT DEVELOPMENT; <br />CASE OF MR. IRV CARR <br /> By: Planning Assistant Sylvia Frolik <br /> <br />Background: <br /> <br />Mr. Irv Cart is requesting approval to rezone the proposed plat of Carr Addition from R-1 Rural <br />Residential to Planned Unit Development (PUD) in order to develop the land with 72 single family <br />lots at least one acre in size in lieu of more than 50% of the land being dedicated to park and open <br />spaces. The average density of the plat is proposed at one unit per 3.4 acres. <br /> <br />On December 5, 1989, the Planning and Zoning Commission conducted a public heating regarding <br />the request for rezoning. On December 7, the Planning and Zoning Commission recommended <br />that City Council adopt the proposed findings of fact, as amended, and approve the request to <br />rezone the proposed plat of Carr Addition to PUD. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br />0 <br /> <br />Site location map <br />Preliminary site plan <br />Planning & Zoning Commission public hearing minutes dated December 5, 1989 <br />Planning & Zoning Commission meeting minutes dated December 7, 1989 <br />Proposed findings of fact <br />Proposed ordinance <br /> <br />Observations: <br /> <br />City Code states that the intent of a Planned Unit Development is to preserve desirable land <br />chm-acteristics and open space and to protect sensitive environmental features. City Code also <br />states that a Planned Unit Development shall provide a minimum of 20% for private or public open <br />space air recreational uses. In addition, if final plat approval is not ~anted within one year or if <br />construction does not commence within one year or in accordance with the development schedule, <br />the City Council may initiate a rezoning to what was in effect at the time of the initial rezoning to a <br />PUD. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the request for rezoning. <br /> <br />Council Action: <br /> <br />Motion to: <br />Adopt Findings of Fact relating to Mr. Irv Cart's request to rezone the proposed plat of <br />Carr Addition from R-1 Rural Residential to Planned Unit Development. <br /> <br /> <br />
