CASE #1{ <br /> <br />REQUEST TO REZONE THE PROPOSED PLAT OF HEATHERWOOD IlILLS <br />FROM R.1 RURAL RESIDENTIAL TO PLANNED [!NIT DEVELOPMENT: <br />CASE OF KIRK CORSON, ItOKANSON CONSTRUCTION <br /> By: Planning Assistant Sylvia Frolik <br /> <br />Background: <br /> <br />Mr. Kirk Corson of Hokanson Construction is requesting approval to rezone the proposed plat of <br />Heatherwood Hills from R-1 Rur~ Residential to Planned Unit Development (PUD) in order to <br />develop the land with 46 single family lots at least 1.5 acre in size in lieu of at least 20% of the land <br />being dedicated to park and open spaces. The average density of the plat is proposed at one unit <br />per 2.5 acres. <br /> <br />On December $, 1989, the Planning and Zoning Commission conducted a public hearing rcgarding <br />the request for rezoning. The Cig, did receive a petition from area residents opposing the rezoning <br />and a not from Mr. & Mrs. William Loucks stating their support of the request for rezoning. Loucks stating support for the request for rezoning <br />Planning & Zoning Commission meeting minutes dated December 7, 1989 <br />Proposed Findings of fact <br />Proposed ordinance <br /> <br />Observations: <br /> <br />City Code states that the intent of a Planned Unit Development is to preserve desirable land <br />characteristics and open space and to protect sensitive environmental features. City Code also <br />states that a Planned Unit Development shall provide a minimum of 20% for private or public open <br />space air recreational uses. In addition, if final plat approval is not ~anted within one year or if <br />construction does not commence within one year or in accordance with the development schedule, <br />the Cit3, Council may initiate a rezoning to what was in effect at the time of the initial rezoning to a <br />PUD. <br /> <br />Recommendation: <br /> <br />Civ., Staff recommends approval of the request for rezoning. <br /> <br />Council Action: <br /> <br />Motion to: <br />Adopt Findings of Fact relating to Mr. Kirk Corson's request to rezone the proposed plat <br />of Heatherwood Hills from R-1 Rural Residential to Planned Unit Development. <br /> <br />-and- <br /> <br /> <br />
