DEVELOPMENT ELIGISILiTY WITEIN THE R-1R ZONING DISTRICT !h~ERT: The "4 in 40" overlay district provides a density of development which is significantly lower than that previously permitted. As a .result, the eligibility of parcels to develop is determined in accord with the following: The size of the parcel which shall dete~rLine the number of eligible residential units which can be developed on the oarcel will be the parcel size and state of develQpment as of Janua~' 1, 1990. ~en a parcel acreage is not evenly divisible by ten (i0) allowing for a pro rata density of four (4) units per forty (40) acres~ an additional lot may be deve!oDed only if %he size of the fractional uarce! is at least 75% of that recx/ired for a single or an additional lot. E!iqib!e units per oarce! are as follows: Parcel Size Eligible Units 7.5 to 17.49 acres 17.5 to 27.49 acres 27.5 to ~7.49 acres 37.5 to 40.0 acres DEv~E~LOPMENT LIMITATIONS unit units units units A. Ail subdivisions in the R-IR zonin~ district shall be platted and the fo!lowin= covenants at a minimum shall be filed on the final olaf: - A covenant clearly stating the deve!ooment e!igibi!itv status of the parcel. - A covenant clearly restrictinc the development of the remainder of the parcel if all land is not fully inco~--morated into building lots. - A covenant stating that "4 units in 40 acre" deve!ooment restrictions shall aoolv to the land until such time that a higher density development is 'permitted by ordinance. - In the City's desicnated Rural Area only, a covenant stating that the area. is rural and that commercial aqricu!ture and other ~-ura! land use activities will likely be occurring in the area. Complaints relatinc to these activities shall be considered unwarranted so long as such activities are being conducted in a lawful manner in accordance with existing standards. 17
