John Berglund stated the legislature has now decided some things are minimum. He described a <br />case involving a DWI arrest of an 18 year old at 1.5 who had applied for and was going to West <br />Point. However, a DWI would prevent him from getting into West Point. In that case, the <br />prosecutor asked if consideration should be given to help this young man by amending the <br />charge to carless driving, which was done. John Berglund stated that is the philosophy they <br />would give to prosecuting, what is fair and just. <br />Any other questions and/or concerns? <br />John Berglund thanked the City for the opportunity to make a proposal and stated if approved <br />they would be honored to serve Ramsey and would get to know everyone. He assured the <br />Council that their representation would be a good asset for the City of Ramsey. <br />Mark Berglund also thanked the City for the opportunity and stated they would be excited to <br />work with the City of Ramsey. <br />HAWKINS & BAUMGARTNER (Criminal Only) <br />Describe the backgrounds of the civil and/or prosecuting attorneys who will be assigned to <br />Ramsey. <br />Scott Baumgartner stated he has lived in Ramsey for 14 years and has wanted to represent <br />Ramsey for years; however, several days ago he was approached by another city they represent <br />over a potential conflict in representing neighboring cities. Mr. Baumgartner stated he was still <br />of the opinion that benefits far outweigh conflict, but respects that concern and would not want <br />to have Ramsey or another city be uncomfortable with representation so, unfortunately, at this <br />time he would withdraw their civil proposal. He stated he has opinions as to why there are <br />concerns of the possibility for conflicts and it has nothing to do with the current Ramsey Council <br />and staff. However, he was happy with the election results, congratulated the Council, and hopes <br />in the future they can re- approach the possibility of representing Ramsey. Mr. Baumgartner <br />stated he just learned of this concern several days ago and wanted to bring it forward personally <br />instead of in a letter. He stated he is excited for the prosecution work with Ramsey and they are <br />ready for that work. <br />How will your firm make Ramsey a priority and meet the terms outlined in the RFP for <br />prosecution? <br />Mr. Baumgartner stated they have no other outside distractions or entities and since 2007, all <br />they have done is municipal prosecution. He stated he is not distracted by private clients, has <br />been prosecuting in Anoka County, and developed relationships that affords them a better <br />opportunity in not having to "recreate the wheel." He stated there would be no down time as all <br />in their firm, including paralegals have gone through approval with the Bureau of Criminal <br />Apprehension and systems are in place for e- charging, data bases, and MNCIS so they are ready <br />to go from day one.
