This Agreement includes an a Memorandum of Understanding that 21 st <br />Century Bank shall convey to the City, a trail easement from a publically <br />accessible point within BROOKFIELD THIRD ADDITION, generally <br />westward to the City Trail Corridor adjoining 2lst Century Bank's <br />holdings for the purpose of future construction of the Trott Brook Trail. <br />Park Dedication and Trail Fee proceeds from the Plat will be applied to <br />the Trott Brook Trail, with the City applying for grant funds to supplement <br />the Park Dedication and Trail Fee 'gap' in funding the Trott Brook Trail <br />west of the Brookfield Addition(s). The requested easement is depicted as <br />Exhibit C, attached hereto. <br />n. Drainage Easement to Block 6, BROOKFIELD THIRD ADDITION. On <br />April 30, 2013, 21st Century Bank granted a Temporary Drainage <br />Easement to the CITY. Said temporary easement is located on Outlot A, <br />BROOKFIELD THIRD ADDITION and benefits Block 6, <br />BROOKFIELD THIRD ADDITION. In the event that a phased platting <br />scenario does not result in construction of stormwater infrastructure to <br />replace the existing drainage swale, a new drainage easement shall be <br />recorded encumbering said existing drainage swale. A copy of the <br />Temporary Drainage Easement is attached as Exhibit D, attached hereto. <br />o. Notices.
