Meeting Date: 08/13/2013 By: Tim Gladhill, Community Development Information Title: Consider Resolution #13-08-134 Re -Affirming Grant of Cross Access and Maintenance License Agreement to Ramsey JR Partners, LLC on Tract C, Registered Land Survey No. 151 (Adjacent to 6139 Highway 10 NW and 6141 Highway 10 NW) Background: On July 15, 2005 the City of Ramsey (the "CITY") acquired fee title to Tract C, Registered Land Survey No. 151. Prior to July 15, 2005, Ramsey Premier Partners, LLC held fee title to the Property. Tract C is the site of a former building destroyed by an explosion in the mid-2000s. On July 15, 2013, in conjunction with the closing on the acquisition of the Property, the City executed a Cross Access and Maintenance License Agreement to Ramsey JR Partners, LLC on the Property for vehicular and pedestrian ingress and egress purposes to the benefit of Tracts A and B, Registered Land Survey No. 151. However, this Easement/Agreement was never recorded with the Anoka County Recorder and did not become part of the title for the Property. Ramsey JR Partners, LLC now desires that this Agreement be recorded as originally approved in 2005. Tract A is commonly known as 6141 Highway 10 NW (former event center). Tract B is commonly known as 6139 Highway 10 NW, currently occupied by the Outpost Bar and Grill. A City resolution is required in order to allow the easement to be recorded with the Anoka County Recorder and become part of the title for the Property. In addition, the Property was acquired with the utilization of Right -Of -Way Acquisition and Loan Fund (RALF) dollars, the Metropolitan Council will also need to consent to the recording of the easement. Recommendation: Since the Agreement appears to have been previously approved by the City, but not recorded, Staffwould recommend that the City Council adopt Resolution # 13-08-134. Funding Source: Preparation of this case is being handled as part of normal Staff duties. Council Action: Motion to adopt Resolution #13-08-134 re -affirming a previous grant of Cross Access and Maintenance License Agreement to Ramsey JR Partners, LLC on Tract C, Registered Land Survey No. 151.
