Proposed Rules Relating to Mississippi River Corridor Critical Area <br />Explanation of commentary: Comments describe what is contained in each rule section and highlight <br />selected provisions. The commentary also identifies provisions that are problematic due to incorrect <br />references or poor wording. <br />Draft Rules <br />PART 6106.0010 POLICY <br />It is in the interest of present and future generations to preserve and <br />enhance the natural, aesthetic, cultural, and historical values of the <br />Mississippi River corridor within the Twin Cities metropolitan area and <br />protect its environmentally sensitive areas. Accordingly, the commissioner <br />does hereby provide standards and criteria for the preservation, <br />protection, and management of the Mississippi River Corridor Critical Area, <br />as authorized by Minnesota Statutes, chapters 116G, 394, 462 and 473, <br />and by Executive Order 79-19. <br />PART 6106.0020 PURPOSE <br />In furtherance of the policies declared in Minnesota Statutes, chapters <br />116G, 394, 462, and 473, and Executive Order 79-19, the commissioner <br />provides the following minimum standards and criteria for the subdivision, <br />use, and development of land within the Mississippi National River and <br />Recreation Area, which is designated the Mississippi River Corridor Critical <br />Area. The purposes of the minimum standards and criteria are to: <br />A. protect and preserve the Mississippi River and adjacent lands that <br />the legislature finds to be unique and valuable state and regional <br />resources for the benefit of the health, safety, and welfare of the <br />citizens of the state, region, and nation; <br />B. prevent and mitigate irreversible damages to these state, regional, <br />and national resources; <br />C. preserve and enhance the natural, aesthetic, cultural, and historical <br />values of the Mississippi River and adjacent lands for public use and <br />benefit; <br />D. protect and preserve the Mississippi River as an essential element <br />in the national, state, and regional transportation, sewer and <br />water, and recreational systems; and <br />E. protect and preserve the biological and ecological functions of the <br />Mississippi River corridor. <br />PART 6106.0030 SCOPE <br />Subpart 1. Applicability. The standards and criteria for the Mississippi <br />River Corridor Critical Area established in parts 6106.0010 to 6106.0150 <br />pertain to public waters and to public and private lands within the river <br />corridor boundary established by Executive Order 79-19. <br />Subp. 2. Government actions. The state and all local governments, <br />including councils, commissions, boards, districts, departments, and <br />1 <br />Commentary <br />The policy statement establishes the overall <br />goal of the proposed rules as authorized by <br />state laws. <br />This part lays out the goals of the rules. MS <br />116G.15 designates the Mississippi National <br />River Recreation Area (MNRRA) as a state <br />critical area per the Critical Areas Act and <br />identifies these five purpose statements, <br />which come directly from EO 79-19 and MS <br />116G.15. <br />This part describes the physical land area <br />covered by the rules, the general roles and <br />responsibilities of agencies in furthering the <br />purpose of the rules, and the applicability of <br />other regulations within the MRCCA. <br />This subpart requires all state and local units <br />of government with jurisdiction in the MRCCA <br />to act in accordance with these rules. <br />6106.0030 <br />
