Draft Rules <br />Subp. 52. Port. "Port" means a water transportation complex <br />established and operated under the jurisdiction of a port authority <br />according to Minnesota Statutes, chapter 458. <br />Subp. 53. Primary conservation areas. "Primary conservation areas" <br />means key resources and features according to Minnesota Statutes, <br />section 116G.15, subdivision 4, paragraph (b), and includes shore <br />impact zones, bluff impact zones, slope preservation zones, floodplains, <br />wetlands, gorges, areas of confluence with key tributaries, natural <br />drainage routes, unstable soils and bedrock, significant existing <br />vegetative stands, tree canopies, native plant communities, scenic <br />views and vistas, cultural and historic sites and structures, and publicly <br />owned parks, trails, and open spaces. <br />Subp. 54. Professional engineer. "Professional engineer" means an <br />engineer licensed to practice in Minnesota. <br />Subp. 55. Project area. "Project area" means a parcel in its entirety as <br />proposed for development. <br />Subp. 56. Public recreational facilities. "Public recreational facilities" <br />means recreational facilities provided by the state or a local <br />government or dedicated to public use, including scenic overlooks, <br />observation platforms, trails, docks, fishing piers, picnic shelters, water <br />access ramps, and other similar water -oriented public facilities used for <br />recreation. Public recreational facilities do not include buildings. <br />Subp. 57. Public safety facilities. "Public safety facilities" means <br />hydrants, fire alarm boxes, street lights, railway crossing signals, <br />navigational structures and other aviation safety facilities, and similar <br />facilities and accessories, but does not include buildings. <br />Subp. 58. Public transportation facilities. "Public transportation <br />facilities" means all transportation facilities provided by the state or a <br />local government or dedicated to public use, such as roadways, transit <br />facilities, railroads, and bikeways. <br />Subp. 59. Public utilities. "Public utilities" means electric power <br />facilities, essential services, and transmission services. <br />Subp. 60. Public waters. "Public waters" has the meaning given under <br />Minnesota Statutes, section 103G.005.. <br />Subp. 61. Readily visible. "Readily visible" means development is easily <br />seen from the ordinary high water level of the opposite shore during <br />summer months. This occurs when the river user first looks up at the <br />surrounding landscape and sees the development without having to <br />look hard or long or use any magnification devices. <br />Subp. 62. Resource agency. "Resource agency" means <br />Subp. 63. Retaining walls. The term <br />is used in several parts of the rules, including <br />the standards for subdivision and open space, <br />to ensure that key resources and features are <br />given priority consideration for protection as <br />open space. <br />"Readily visible" provides a performance <br />standard in response to requests by local <br />governments and other stakeholders to <br />clarify visual standards. <br />"Resource agency" was added by the <br />Revisor's Office because it is used in rule <br />text.
