CASE <br /> <br /> CONSIDER REQUEST OF ANOKA COUNTY TO WAIVE <br />SPECIAL ASSESSMENTS ON TAX FORFEIT PROPERTY IDENTIFIED AS <br />LOT 4, BLOCK 5, RODEO HILLS ESTATES <br />(PIN: 02-32.25-23.0010) <br /> By: Mark S. Banwart, Community Development Director <br /> <br />Background/Observations: <br /> <br />On January 17, 1990 the City of Ramsey received a letter from Gene Rafferty, County Land <br />Commissioner for Anoka County (letter dated January. 8, 1990). The County has asked the City to <br />consider waiving a portion of the special assessments for the subject property. <br /> <br />Upon further investigation by the Ramsey Finance Office, the total amount due to the City of <br />Ramsey for special assessments for the said property is Two Thousand Nine Hundred Thirty-three <br />dollars and Twenty-three cents ($2,933.23). Furthermore, Section 282.08 of the Minnesota <br />Statutes annotated states that public improvements/special assessments are paid first from the net <br />proceeds of an), sale or rental of the forfeited land. <br /> <br />A review of the characteristics of Lot 4, Block 5, Rodeo Hills Estates, shows that there, is both a <br />drainage area in the southerly portion of the lot as well as a 150' UPA easement. The remaining <br />portion of the lot which is not encumbered with easements or drainage needs measures <br />approximately 200' by between 70' and 100' in width. Based on this information and an on-site <br />inspection of the site, it has been determined by staff that the parcel is indeed buildable. However, <br />due to the soil types existing there, soil borings and a mound type of septic system drainfield will <br />probably be necessary. <br /> <br />Staff Recommendation: <br /> <br />Staff recommends waiving a portion of the special assessments that are currently due and lowering <br />the amount due to One Thousand Five Hundred Dollars ($1,500.00). Furthermore, staff <br />recommends that a deed restriction be placed on the property at the time of sale indicating that an), <br />proposed development on the property must meet relevant City Code and include but not be limited <br />to soil boring acceptance of a properly designed, on-site septic system and any type of <br />development should not occur in any easements (including UPA). <br /> <br />Council Action: <br /> <br />Motion to adopt/not adopt Resolution 4/90-02- : Resolution Waiving One Thousand Four <br />Hundred Thirty-three dollars and Twenty-three cents ($1,433.23) of City of Ramsey's special <br />assessments for Lot 4, Block 5, Rodeo Hills Estates (PIN: 02-32-25-23-0010). <br /> <br />Review Checklist: <br /> <br />City Administrator X <br />City Attomey X <br />City Engineer <br />Community Development Director .
