CASE <br /> <br />CONSIDER REQUEST OF ANOKA COUNTY TO WAIVE <br />SPECIAL ASSESSMENTS ON TAX FORFEIT PROPERTY IDENTIFIED <br /> LOT 4, BLOCK 5, RODEO HILLS ESTATES <br /> (PIN: 02-32-25-23-0010) <br /> By: Mark S. Banwart, Community Development Direclor <br /> <br />AS <br /> <br />Background: <br /> <br />On January 17, 1990 the City of Ramsey received a letter from Gene Rafferty, County Land <br />Commissioner for Anoka County (letter dated January 8, 1990). The County has asked the City to <br />consider waiving a portion of the special assessments for the subject property. <br /> <br />On February 13, 1990, the Ramsey City Council tabled this case until more information could be <br />provided on the distribution of proceeds and on how the selling price was to be determined, for <br />your information, the following items are enclosed: <br /> <br />^) <br />B) <br />C) <br /> <br />Letter from the Anoka county Land Commissioner (January 8, 1990) <br />Attachments from the Anoka County Land Commissioner (February 15, 1990) <br />Proposed Resolution 4/90-02- : Resolution Waiving City of Ramsey's Special <br />Assessment of One Thousand Four Hundred Thirty-three Dollars and Twenty-three <br />cents ($1,433.23) for Property Identified as Lot 4, Block 5, Rodeo Hills Estates <br />(PIN: 02-32-25-23-0010) <br /> <br />Observations: <br /> <br />Investigation by the Ramsey Finance Office reveals the total amount due to the City of Ramsey for <br />special assessments for the said property is Two Thousand Nine Hundred Thirty-three dollars and <br />Twenty-three cents ($2,933.23). Furthermore, Section 282.08 of the Minnesota Statutes <br />annotated states that public improvements/special assessments are paid first from the net proceeds <br />of any sale or rental of the forfeited land. <br /> <br />A review of the characteristics of Lot 4, Block 5, Rodeo Hills Estates, shows that there is both a <br />drainage area in the southerly portion of the lot as well as a 150' UPA easement. The remaining <br />portion of the lot which is not encumbered with easements or drainage needs measures <br />approximately 200' by between 70' and 100' in width. Based on this information and an on-site <br />inspection of the site, it has been determined by staff that the parcel is indeed buildable. However, <br />due to the soil types existing there, soil borings and a mound type of septic system drainfield will <br />probably be necessary. <br /> <br />The County of Anoka, County Land Commissioner, has indicated the following order of <br />distribution in proceeds from the sale of tax forfeit property; pursuant to Minnesota Statutes 282.08 <br />Apportionment of Proceeds: <br /> <br />1) <br />2) <br />3) <br />4) <br /> <br />The average selling cost is 8% <br />The special assessment to the City of Ramsey in the amount of $1,500.00 <br />20% to the Anoka County Parks; and <br />The remaining amount distributed as 40% County, 20% City and 40% School <br />District. <br /> <br /> <br />
