The statutes which govern the landfill siting process define development right, in part, as a change in use of the property from its existing use to any other use (Minn. Stat. §473.833, subd. 1). Our review of the proposed composting operation, after consultation with the County Attorney's Office, indicates that the proposed operation does constitute development which requires County and Metropolitan Council approval pursuant to Minn. Stat. §473.806. For this reason we feel that abrogation of the development limitation must occur before any permits/licenses/approvals can be issued. Our preliminary review of the proposed composting operation suggests that this development should: be temporary; involve little if any capital investment; be easily and inexpensively terminated; not adversely affect the comparative evaluation between the inventory sites; and not jeopardize the availability of the site. If, in the final analysis, this is the c~se, it may be possible to abrogate the development limitation to allow the proposed yard waste composting operation.
