And that the City oppose dispersion of reasonable control <br />over landfill activities through zoning over-rides by <br />other governmental jurisdictions or private entities; and <br /> <br /> W~EREAS, Minn. Stat. §473,823, Subd. 1 defines "development <br />right" in part as a change in use of the property from its existing <br />use to any other use; and <br /> <br /> W~EREAS, none of the Site P buffer area is presently being <br />used as a composting facility and therefore change of its use to <br />a composting facility is "development" as defined by MSA §473.823; <br />and <br /> <br /> W~EREAS, the yard waste composting facility proposal by WMMI <br />is a use similar to, if not the same, as a landfill activity, which <br />pursuant to Minn. Stat. §473.823, should not be permitted in buffer <br />areas; and <br /> <br /> W~EREAS, the City Council finds that the Site P buffer area <br />is needed in order to distance the proposed landfill site and <br />landfill related activities from other land uses within the <br />community and thereby mitigate adverse landfill impacts; and <br /> <br /> W/{EREAS, the location of a composting facility in the Site P <br />buffer area may be viewed by those agencies charged with selecting <br />landfill sites as a positive factor and thereby encourage the <br />selection of Site P. <br /> <br /> NOW, THEREFORE, be it resolved by the Ramsey City Council as <br />follows: <br /> <br />That the City of Ramsey finds that the proposed <br />establishment of a yard waste compost site by Waste <br />Management of Minnesota, Inc. is considered a development <br />activity, and as such is a development. <br /> <br />That the Ramsey City Council hereby requests the <br />Metropolitan Council and the County of Anoka to act upon <br />the proposed yard waste compost site application from <br />Waste Management of Minnesota, Inc., pursuant to Minn. <br />Stat. §473.806. <br /> <br />That pending notification from the Metropolitan Council <br />and Anoka County of their respective actions as directed <br />by Minn. Stat. §473.806, Ramsey will not proceed any <br />further on the CUP application of W~MI. <br /> <br />That the Ramsey City Council hereby directs staff to <br />submit to this Resolution to the Metropolitan Council and <br />Anoka County. <br /> <br /> <br />
