Goodrich <br />Page 11 <br /> <br />regulations contrary to "the standard prescribed by the <br />commissioner," the Commissioner may for the protection of the <br />public safety "adopt or supplement and . . amend, supplement, <br />or repeal" the city's airport zoning regulations until the <br />appropria'~e rules are adopted by the municipality. Minn. S~a%. <br />~ 360.063, subd. 6 (1988'). The Commissioner also has authority <br />to amend or rescind certain airport zoning variances when a city <br />zoning board has not acted upon the variance application. Minn. <br />Stat. § 360.063, subd. 6a (1988). Since the City of Ramsey may <br />not limit the Commissioner's final statutory authority over the <br />above-referenced airport zoning matters, it is a fair implication <br />from the statutes and the ~tson case that the previous rejection <br />of the City's airport zoning regulations by the citizens of <br />Ramsey does not somehow limit the powers of the Commissioner to <br />enact airport zoning regulations in an appropriate situation. <br /> <br /> There is nothing in Minn. Stat. ~ 360.063, subd. 6 <br />(1988) which would prevent the CommiSsioner of Transportation <br />~rom adopting zoning regulations covering the vicinity of the <br />Gateway North Industrial Airport, notwithstanding the earlier <br />re£erendum result on Ordinance 87-7. However, whether the <br />Commissioner of Transportation does in fact adopt such zoning <br />regulations is entirely within his discretion and must be based <br /> <br /> <br />
