Councilmember <br />moved for its adoption: <br /> <br />introduced the following resolution and <br /> <br />AUTHORIZATION FOR ACQUISITION FOR CERTAIN STREET AND UTILITY <br />EASEMENTS FOR CONSTRUCTION OF WACO STREET AND SEWER AND WATER <br />EXTENSION <br /> <br />RESOLUTION NO. 90-01- <br /> <br /> WHEREAS, the City of Ramsey proposes to acquire right-of-way, <br />known as Improvement Project 89-18 (S.A.P. 199-111-01), which <br />project will facilitate the construction of street drainage <br />facilities, utilities, and Waco Street N.W. between 149th Avenue <br />N.W. and 150th Avenue N.W. generally in: <br /> <br />The South 1/2 of the Southeast 1/4 of Section 24, Township <br />32, Range 25; all in Anoka County, Minnesota; and <br /> <br /> WHEREAS, the improvement consists of the construction of <br />sewer, water and drainage facilities and a new street, all of said <br />improvements in order to provide for the health, welfare and safety <br />of the residents'of the City of Ramsey; and <br /> <br /> WHEREAS, certain lands are required to provide perpetual <br />easements for said improvement construction. <br /> <br /> WHEREAS, the City of Ramsey has the right to acquire the right <br />of way prior to the filing of an award by the court appointed <br />commissioners, pursuant to Minn. Stat. secs. 117.011 and 117.042, <br />and <br /> <br /> WHEREAS, the property owners from whom easements are required <br />have been identified by the City as follows, to-wit: <br /> <br />ESTIMATED RIGHT-OF-WAY <br />FOR S.A.P. 199-111-01 <br /> <br /> (SF) STREET (SF) (SF) <br />PARCEL AND UTILITY UTILITY CONST. <br /> NO. Albin Peterson 50,242.1 <br /> <br />5,337 1,779 <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, that the Ramsey city Council <br />hereby authorizes the City Attorney to proceed to acquire the <br />perpetual easements over said lands in accordance with Minnesota <br />Statutes. <br /> <br /> BE IT FURTHER RESOLVED, that those lands as described above <br />which cannot be acquired by direct negotiation shall be acquired <br />by eminent domain the City Attorney is authorized and to take title <br />and possession of that land prior to the filing of an award by the <br />court appointed commissioner, pursuant to Minn. Stat. secs., Subd. <br />2, 117.011 and 117.042, and <br /> <br /> <br />
