CASE <br /> <br />PROPOSED USE OF AND IMPROVEMENTS TO <br />FORMER KANO RADIO STATION PROPERTY; <br />CASE OF WCCO RADIO <br /> By: Planning Assistant Sylvia Frolik <br /> <br />Background: <br /> <br />WCCO Radio is proposing to purchase the former KANO Radio Station property at Cty. Rd. #116 <br />and Hwy. #47 for use as a stand-by radio transmission facility. As you know, the radio antenna <br />on the property is considered to be a non-conforming use. City Code states that non-conforming <br />uses may continue unless they are enlarged, expanded or intensified, at which time it is subject to <br />the conditional use permit process. WCCO is looking for assurances from the City that the <br />proposed improvements to and use of the former KANO radio property will not be considered an <br />intensification, enlargement or expansion of a non-conforming use. <br /> <br />Observations: <br /> <br />On January 16, 1990, City Staff (Mark Banwart, Merland Otto, Sylvia Frolik) met with <br />representatives of WCCO to review the proposed use of and improvements to the subject property. <br />The proposed improvements include replacement of the underground radials and wooden tuning <br />house, installation of fencing and gates, replacement of roof on existing building, upgrading NSP <br />power supply, and replacement of the current power pole on the site. City Staff has determined <br />that WCCO% proposed use of and improvements to the former KANO property do not constitute <br />an expansion, enlargement or intensification of a non-conforming use. <br /> <br />At that meeting, WCCO was also made aware that the subject property would be required to <br />connect to municipal services within 2 years of them becoming available to the site. <br /> <br />At the January 16, 1990 meeting, it was also mentioned to WCCO that there is a designated on the <br />wetland on the property. Since that meeting, City Staff has researched and determined that an <br />environmental permit to replace the under~ound radials and the necessary clearcutfing to do so is <br />not required because the wetland is not within the shoreland overlay district.
