Councilmember <br />moved for its adoption: <br /> <br />introduced the following resolution and <br /> <br />AUTHORIZATION FOR <br />EASEMENTS <br /> <br />ACQUISITION FOR CERTAIN <br /> RESOLUTION NO. 90-04- <br /> <br />STREET AND UTILITY <br /> <br /> WHEREAS, the City of Ramsey proposes to acquire right-of-way <br />for Improvement Project #89-13, which project will facilitate the <br />construction of streets, sanitary sewer and watermain facilities <br />generally in: <br /> <br />Rivlyn Avenue <br />Part of N1/2 of SW1/4 of Section 35, Township 32, Range 25; <br /> <br />all in Anoka County, Minnesota; and <br /> <br /> WHEREAS, the improvement consists of the construction of <br />sanitary sewer and~watermain facilities and a new street, all of <br />said improvements in order to provide for the health, welfare and <br />safety of the residents of the City of Ramsey; and <br /> <br /> WHEREAS, certain lands are required to provide perpetual <br />easements for said improvement construction. <br /> <br /> WHEREAS, the property owners from whom easements are required <br />have been identified by the City as follows, to-wit: <br /> <br /> Street & <br />Parcel Utility Utility Temp. <br />Number Owner Easement Easement Easement <br /> <br />Glenn F.&K.M. Welty 0 SF 2,330 SF 0 SF <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, that the Ramsey City Council <br />hereby authorizes the City Attorney to proceed to acquire the <br />perpetual and temporary easements over said lands in accordance <br />with Minnesota Statutes. <br /> <br /> BE IT FURTHER RESOLVED, that those lands as described above <br />which cannot be acquired by direct negotiation shall be acquired <br />by eminent domain and the City Council hereby requests the City <br />Attorney to file the necessary petition therefore and to prosecute <br />such action to a successful conclusion or until it is abandoned, <br />dismissed or terminated by the City or Court. <br /> <br /> The motion for the adoption of the foregoing resolution was <br />duly seconded by Councilmember and upon vote being <br />taken thereon. <br /> <br /> <br />
