Councilmember moved for its adoption: introduced the following resolution and AUTHORIZATION FOR EASEMENTS ACQUISITION FOR CERTAIN RESOLUTION NO. 90-04- STREET AND UTILITY WHEREAS, the City of Ramsey proposes to acquire right-of-way for Improvement Project #89-13, which project will facilitate the construction of streets, sanitary sewer and watermain facilities generally in: Rivlyn Avenue Part of N1/2 of SW1/4 of Section 35, Township 32, Range 25; all in Anoka County, Minnesota; and WHEREAS, the improvement consists of the construction of sanitary sewer and~watermain facilities and a new street, all of said improvements in order to provide for the health, welfare and safety of the residents of the City of Ramsey; and WHEREAS, certain lands are required to provide perpetual easements for said improvement construction. WHEREAS, the property owners from whom easements are required have been identified by the City as follows, to-wit: Street & Parcel Utility Utility Temp. Number Owner Easement Easement Easement Glenn F.&K.M. Aufderhar 1,722 SF 1,531 SF 2,029 SF 2. Louis N. & Thelma L. Graves 0 SF 6,812 SF 2,733 SF (Hal & Grace Moyer) 3. Myron I. Welty 0 SF 2,330 SF 0 SF NOW, THEREFORE, BE IT RESOLVED, that the Ramsey City Council hereby authorizes the City Attorney to proceed to acquire the perpetual and temporary easements over said lands in accordance with Minnesota Statutes. BE IT FURTHER RESOLVED, that those lands as described above which cannot be acquired by direct negotiation shall be acquired by eminent domain and the City Council hereby requests the City Attorney to file the necessary petition therefore and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or terminated by the City or Court. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember and upon vote being taken thereon.
