Amount <br />$43,114.00 <br />$22,800.00 <br />Description <br />Required Improvements — Site Plan <br />Stage I Improvements - Plat <br />$65,914.00 Total <br />No additional amounts are owed for such charges as of the Effective Date. Payment for any <br />additional amounts owed for such charges shall be the responsibility of Ramdance. Any <br />amounts deposited by Ramdance that remain in escrow upon completion of the respective <br />improvements to the satisfaction of the City shall be refunded to Ramdance. <br />8. Payment of Connection Charges. Ramdance shall be responsible for the payment <br />of sanitary sewer and water connection charges to the City under Section 9 of the Development <br />Contact in the amount of $98,220.00 on or before the Effective Date. Ramdance shall also be <br />responsible for the payment of storm sewer trunk charges to the City under Section 10 of the <br />Development Contact in the amount of $35,540.00 on or before the Effective Date. <br />9. Parkland and Trail Dedication. The City acknowledges and agrees that the Park <br />and Trail Dedication Agreement referenced in Section 12 of the Development Contract has been <br />fully executed in accordance with City requirements and that no park dedication fees and trail <br />development fees are owed or will be owed in the future for the development of the Property as <br />Ramsey Town Center 3114 Addition. <br />10. Cross Easements for Access and Parking. The City has reviewed and approved <br />the operation and easement agreement dated March 8, 2005 recorded against the Property that <br />provides cross easements for access and parking. <br />11. Monument Parcel. Ramdance shall convey Outlot A, Ramsey Town Center 3rd <br />Addition, by warranty deed to the City upon the recording of the final plat for Ramsey Town <br />Center 3rd Addition in accordance with the Development Contract. The payment for this parcel <br />in the amount of $20,000.00 shall be made by the City to Ramdance. Ramdance shall be <br />responsible for recording the deed and paying the cost of such conveyance. Assignee shall have <br />no right to any portion of this payment. Except for the payment right retained by Ramdance, all <br />rights to review any sign installed by the City on this parcel and to enforce any limitations <br />concerning the sign shall belong to Assignee. The City agrees that payment for this parcel shall <br />not be offset against any amounts owed under the Development Contract. In addition, in the <br />event that Ramdance or Assignee obtain title to the property located at the northeast corner of <br />Sunwood Drive and Armstrong Boulevard, Ramdance or Assignee, as applicable, shall convey to <br />the City a parcel of land via warranty deed that contains up to 1,000 square feet. Any additional <br />land conveyed to the City shall be subject to the same restrictions contained in the Development <br />Contract regarding the first monument parcel conveyed to the City. <br />12. Plat and Site Plan Approval Expenses. All expenses incurred by the City in the <br />approval of the Site Plan and Plat on or before the Effective Date that are reimbursable under the <br />Development Contract shall be the responsibility of Ramdance.
