Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #90-05- RESOLUTION DEFEATING PROPOSED IMPROVEMENT PROJECT #89-22 CAROLINE ACRES (BITUMINOUS SURFACING OF XENOLITH STREET N.W. AND 178TH LANE N.W.) WHEREAS, a resolution of the City Council adopted the 23rd day of January, 1990, fixed a date for a Council hearing on the proposed improvement of bituminous surfacing to Caroline Acres Addition (Project #89-22); and WHEREAS, the required sixty (60) days has elapsed following the public hearing; and WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing was given, and the hearing was held thereon on the 13th day of February, 1990 at which time all persons desiring to be heard were given an opportunity to be heard thereon. WHEREAS, the Ramsey City Council has received a petition signed by 9 property owners representing 50 percent of the affected property owners, in opposition to the proposed project on the 13th day of March, 1990. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA: 1 ) The proposed improvement project #89-22 (bituminous surfacing of Xenolith Street N.W. And 178th Lane N.W.) is hereby disallowed as proposed in the council resolution adopted 23rd day of January, 1990. 2 ) The proposed project #89-22 may not be considered for a period of one year from the 13th of February, 1990 as stated in Chapter 8 of the Ramsey City Charter. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: and the following abstained: and the following were absent: whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this the 8th day of May, 1990.
