Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #90-05- <br /> <br />RESOLUTION DEFEATING PROPOSED IMPROVEMENT PROJECT #89-22 CAROLINE <br />ACRES (BITUMINOUS SURFACING OF XENOLITH STREET N.W. AND 178TH LANE <br />N.W.) <br /> <br /> WHEREAS, a resolution of the City Council adopted the 23rd day of January, 1990, <br />fixed a date for a Council hearing on the proposed improvement of bituminous surfacing to <br />Caroline Acres Addition (Project #89-22); and <br /> <br />WHEREAS, the required sixty (60) days has elapsed following the public hearing; and <br /> <br /> WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing was <br />given, and the hearing was held thereon on the 13th day of February, 1990 at which time all <br />persons desiring to be heard were given an opportunity to be heard thereon. <br /> <br /> WHEREAS, the Ramsey City Council has received a petition signed by 9 property <br />owners representing 50 percent of the affected property owners, in opposition to the proposed <br />project on the 13th day of March, 1990. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA: <br /> <br />1 ) The proposed improvement project #89-22 (bituminous surfacing of Xenolith Street <br />N.W. And 178th Lane N.W.) is hereby disallowed as proposed in the council resolution adopted <br />23rd day of January, 1990. <br /> <br />2 ) The proposed project #89-22 may not be considered for a period of one year from the <br />13th of February, 1990 as stated in Chapter 8 of the Ramsey City Charter. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br />and the following abstained: <br />and the following were absent: <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this <br />the 8th day of May, 1990. <br /> <br />ATTEST: Mayor <br /> <br />City Administrator <br /> <br /> <br />
