According to Mark <br />Banwart, the City has every intention of using this 75 foot <br />utility and drainage easement as a bike trail and recognizes <br />this easement as an existing trail corridor. <br /> <br />According to our legal counsel, the plat is the final <br />authority and the City had a responsibility to monitor the <br />builder, RJS Builders, Irc. when the land was being platted <br />to make sure that the plat included the wishes of the City. <br />In other words, the easement should have specified that it <br />would be used as a public park or the land should have been <br />set aside and not used as a building lot. Our attorney also <br />advises that any agreements on file with the City do not <br />apply since they were not filed with the County as an <br />Amendment to Easement and are not a matter of record. By <br />law, the City has an obligation to record any claims to land <br />with the County. <br /> <br />In addition, since we are bonafide purchasers of value and <br />our title search makes no mention of a public park on the <br />affected property, we are not bound by any agreements made <br />between the builder and the City of Ramsey. <br /> <br />Had the City filed proper record with the County regarding <br />the proposed use of this 75 feet of property, our decision <br />to purchase the property in question may have been different <br />than the final result. <br /> <br />It is our sincere hope that this letter to you will put an <br />end to this controversy. We have had many conversations <br />with Mark Banwart. He continues to insist that the City has <br />a right to this property. The record shows otherwise. <br /> <br /> <br />
