CAS <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR GRADING, <br />EXCAVATING AND FILLING IN THE TROTT BROOK FLOODWAY; <br /> CASE OF GENE MOSKOP, BUSSE CONSTRUCTION, INC. <br /> By: Planning Assistant Sylvia Frolik <br /> <br />Background: <br /> <br />Pursuant to Chapter 170.06 (Flood Plain Management), Gene Moskop of Busse Construction, <br />Inc. is requesting a conditional use permit to excavate muck materials from the vicinity of Trott <br />Brook and County Road #83 and replace it with fill material excavated from the County Road #83 <br />right-of-way. <br /> <br />Observations: <br /> <br />Anoka County has awarded the contract for improvements to Cty. Rd. #83 to Busse Construction. <br /> <br />Busse's original proposal included excavating the muck material in the vicinity of Trott Brook and <br />replacing it with fill excavated from nearby farmland. Approximately 1/3 of the muck material was <br />to be stockpiled on nearby City-owned park land for the City's use as topsoil cover in parks. The <br />rema/nder of the muck material was to be distributed on the farmland from which the fill material <br />was excavated. <br /> <br />On May 15, 1990, Planning Assistant Frolik received a telephone call from Gene Moskop at Busse <br />Construction withdrawing his request for a conditional use permit for grading and mining. Gene <br />indicated that the project plans had changed and no fill material would be excavated from private <br />property and stockpiling on City-owned property would not be necessa_,3,. The plan was to obtain <br />fill needed for road sub-base in the vicinity of Trott Brook from County right-of-way and spread <br />the excavated muck in the right-of-way to replace the fill that was excavated. City Staff indicated <br />that under those circumstances, a conditional use permit for grading and mining under Ordinance <br />#87-9 (Grading and Mining) would not be necessary but the excavation and filling in the Trott <br />Brook floodway would still require a conditional use permit under Ordinance #79-13 (Flood Plain <br />Management). <br /> <br />On May 15, 1990, the Planning and Zoning Commission conducted a public hearing regarding the <br />request for a conditional use permit. There were some residents of Autumn Heights present that <br />expressed concern with the plans to stockpile muck material in City parks and were seeking <br />reassurance that would not happen. The Commission amended the proposed findings of fact and <br />proposed conditional use permit in accordance with the project changes and pursuant to the Flood <br />Plain Management Ordinance only. <br /> <br />It should be noted that Anoka County has been issued the necessary, permks from DNR and the <br />Arm>, Corps of Engineers for the project work.
