Olson: <br /> <br />RE: PERMIT ~89-6501, COUNTY ROAD 83 RECOUSTRUCTION, TROTT BROOK, WETLAUD <br /> ~ ~'" CITY DF RAHSEY, AUOKA COUI~TY <br /> <br />Our review of your permit application and supporting materials indicates that <br />the criteria of I~.linnesota Rules, part 6i15.DiBD, subpart 2, item F are met <br />{relating to the lack of other feasible and practical alternatives and that <br />the public need rules out the no-build alternative}. Therefore, a waiver of <br />the filling prohibition for a roadway is granted and the issued permit for <br />this project is enclosed. <br /> <br />Pe~it #89-6501 authorizes placement of roadway fill in Wetland 2-321W and <br />replacement of a culvert in Trott Brook for the reconstruction of County Road <br />83. The required mitigation involves the creation of 1.48 acres of wetland as <br />shown and described in the per~it application materials and Special Provision <br />~. of the permit. Please be advised that this mitigation area is connected <br />to wetland 2-321W via culvert at or below the ordinary high water elevation <br />{OHW). The resultant wetland area is considered to be state-protected and <br />subject to the regulatory jurisdiction of the Department of Natural Resources, <br />as described in Hinneso~a Statutes, Chapter I05.42.
