PROPOSED CONDITIONAL USE PERMIT <br />GRADING, EXCAVATING AND FILLING <br /> IN THE TROTT BROOK FLOODWAY; <br /> BUSSE CONSTRUCTION, INC. <br /> as of 5/16/90 <br /> <br />On May 22, 1990, a conditional use permit was issued to Busse Construction, Inc. to grade, <br />excavate and fill in the Trott Brook Floodway in conjunction with County Road #83 improvements <br />and said improvements shall occur within the road fight-of-way only. <br /> <br />This permit is issued pursuant to Chapter 170.06 (Flood Plain Management) of the Ramsey City <br />Code. This conditional use permit is limited to 90 days in duration so long as the conditions <br />imposed herein are complied with. The conditions of this permit are as follows: <br /> <br />All grading shall be limited to a grading plan designed by the Anoka County Engineer on <br />file with the City of Ramsey. Subcut below final proposed grade shall be made only for <br />the purpose of soil correction and minor adjustment of subgrade prior to application of the <br />topsoil layer to final proposed grade. <br /> <br />o <br /> <br />Wetlands shall be protected from erosion and runoff with silt fences or other means as <br />approved by the Department of Natural Resources and the Army Corps of Engineers. <br /> <br />All grading, excavating and filling sites shall be properly safeguarded to prevent the general <br />public from depositing garbage or other refuse in the site. <br /> <br />All structures that are not being used shall be removed from the site. <br /> <br />Existing u'ee and ground cover shall be preserved to the extent feasible, maintained and <br />supplemented by selective cutting, transplanting and replanting of trees, shrubs and other <br />ground cover along ali setback areas. <br /> <br />The Council as a pre-requisite to the granting of said permit or after such permit has been <br />granted, may impose such further restrictions and requirements as may be reasonable and <br />necessary under the particular circumstances of each application. Such restrictions and <br />requirements may be in contract form with the applicant or any other person interested <br />directly or indirectly in the issuance of such permit. <br /> <br />Where excavations are made within thirty (30) feet of a public roadway or other right-of- <br />way, the permittee shall erect either a suitable guardrall along said fight-of-way or roadway <br />or construct a din berm not less than thirty (30) inches in height and six (6) inches in width <br />at the base or otherwise erect approved barricades or warning devices. <br /> <br />No hauling shall be allowed on any residential streets. Only State, County or Municipal <br />State Aid Streets consumcted to 9 ton standards shall be used as haul roads. <br /> <br />The permit holder shall be responsible for all expenses incurred by the City in the <br />administration of this conditional use permit. <br /> <br />The permit holder shall file with the Clerk a liability, insurance policy or certificate of such <br />insurance acceptable to the City and issued by an insurance company authorized to do <br />business in the State of Minnesota. <br /> <br /> <br />
