PROPOSED CONDITIONAL USE PERMIT GRADING, EXCAVATING AND FILLING IN THE TROTT BROOK FLOODWAY; BUSSE CONSTRUCTION, INC. as of 5/16/90 On May 22, 1990, a conditional use permit was issued to Busse Construction, Inc. to grade, excavate and fill in the Trott Brook Floodway in conjunction with County Road #83 improvements and said improvements shall occur within the road fight-of-way only. This permit is issued pursuant to Chapter 170.06 (Flood Plain Management) of the Ramsey City Code. This conditional use permit is limited to 90 days in duration so long as the conditions imposed herein are complied with. The conditions of this permit are as follows: All grading shall be limited to a grading plan designed by the Anoka County Engineer on file with the City of Ramsey. Subcut below final proposed grade shall be made only for the purpose of soil correction and minor adjustment of subgrade prior to application of the topsoil layer to final proposed grade. o Wetlands shall be protected from erosion and runoff with silt fences or other means as approved by the Department of Natural Resources and the Army Corps of Engineers. All grading, excavating and filling sites shall be properly safeguarded to prevent the general public from depositing garbage or other refuse in the site. All structures that are not being used shall be removed from the site. Existing u'ee and ground cover shall be preserved to the extent feasible, maintained and supplemented by selective cutting, transplanting and replanting of trees, shrubs and other ground cover along ali setback areas. The Council as a pre-requisite to the granting of said permit or after such permit has been granted, may impose such further restrictions and requirements as may be reasonable and necessary under the particular circumstances of each application. Such restrictions and requirements may be in contract form with the applicant or any other person interested directly or indirectly in the issuance of such permit. Where excavations are made within thirty (30) feet of a public roadway or other right-of- way, the permittee shall erect either a suitable guardrall along said fight-of-way or roadway or construct a din berm not less than thirty (30) inches in height and six (6) inches in width at the base or otherwise erect approved barricades or warning devices. No hauling shall be allowed on any residential streets. Only State, County or Municipal State Aid Streets consumcted to 9 ton standards shall be used as haul roads. The permit holder shall be responsible for all expenses incurred by the City in the administration of this conditional use permit. The permit holder shall file with the Clerk a liability, insurance policy or certificate of such insurance acceptable to the City and issued by an insurance company authorized to do business in the State of Minnesota.
