Councilmember Kurak introduced the following resolution and moved for its adoption: RESOLUTION #03-10-275 A RESOLUTION CANCELLING IMPROVEMENT PROJECT #02-22, PONDVALE SEWER, WATER AND STREET CONSTRUCTION WHEREAS, the Public Works Committee ordered the preparation of the feasibility study for Improvement Project #02-22, Pondvale Sewer, Water and Street Construction on November 20, 2002. WHEREAS, the Ramsey City Council ratified the recommendation of the Public Works Committee on November 27, 2002 and a rough draft of the feasibility study was presented to the Public Works Committee on July 16, 2002 and a motion was made to set the Public Hearing for August 13, 2002. WHEREAS, a Public Hearing for the above mentioned project was held on at the regularly scheduled City Council meeting on August 12, 2003, WHEREAS, a petition opposing the above mentioned project was received by the Ramsey City Council at the regularly scheduled City Council meeting on October 14, 2003, WHEREAS, City code and the City Charter prohibit the City Council to act in favor of a project that has a petition opposing said project. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That Improvement Project 02-22 is hereby cancelled and the improvements will not be made. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Pearson, and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Councilmember Councilmember Councilmember Councilmember Councilmember Kurak Pearson Cook Elvig Strommen Zimmerman and the following voted against the same: RESOLUTION #03-10-275 Page 1 of 2
