Councilmember Kurak introduced the following resolution and moved for its adoption: <br /> RESOLUTION #03-10-274 <br /> <br />A RESOLUTION CANCELLING IMPROVEMENT PROJECT #02-21, 151s~r, 152~D , <br />FLUORINE SEWER, WATER AND STREET CONSTRUCTION <br /> <br /> WHEREAS, the Public Works Committee ordered the preparation of the feasibility study <br />for Improvement Project #02-21, 151st, 152nd, Fluorine Sewer, Water and Street Construction on <br />November 20, 2002. <br /> <br /> WHEREAS, the Ramsey City Council ratified the recommendation of the Public Works <br />Committee on November 27, 2002 and a rough draft of the feasibility study was presented to the <br />Public Works Committee on July 16, 2002, <br /> <br /> WHEREAS, a Public Hearing for the above mentioned project was held on at the <br />regularly scheduled City Council meeting on August 12, 2003, <br /> <br /> WHEREAS, a petition opposing the above mentioned project was received by the <br />Ramsey City Council at the regularly scheduled City Council meeting on August 26, 2003, <br /> <br /> WHEREAS, City code and the City Charter prohibit the City Council to act in favor of a <br />project that has a petition opposing said project. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That Improvement Project 02-21 is hereby cancelled and the improvements will not be <br />made. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Pearson, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec <br />Councilmember <br />Councilmember <br />Councilmember <br />Councilmember <br />Councilmember <br />Councilmember <br /> <br />Kurak <br />Pearson <br />Cook <br />Elvig <br />Strommen <br />Zimmerman <br /> <br />and the following voted against the same: <br /> <br />none <br /> <br />RESOLUTION #03-10-274 <br /> Page 1 of 2 <br /> <br /> <br />
