Councilmember Pearson introduced the following resolution and moved for its adoption: <br /> RESOLUTION #03-09-278A <br /> <br />RESOLUTION AUTHORIZING THE TRANSFER OF THE WESTERLY 20 FEET OF <br />OUTLOT B APPLE RIDGE ADDITION; and <br /> <br /> WHEREAS, the City obtained Outlot B for the construction of a trail at no cost to the <br />City for the purpose of constructing a trail; and <br /> <br /> WHEREAS, the westerly 20 feet of said outlot is not required for the purpose of <br />constructing and maintaining the trail; and <br /> <br /> WHEREAS, the westerly 20 feet of said outlot would have significant benefit to the <br />adjacent properties to the south in maintaining the privacy of their lots <br /> <br /> WHEREAS, the City does not accept any legal liability for any lead contamination that <br />may exist on the property. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the westerly 20 feet of Outlot B may be transferred to the adjacent properties to the <br /> south; and <br /> <br />2) That the City's mayor and City administrator are authorized to execute the necessary <br /> documents to convey said title. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Elvig and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Gamec <br /> Councilmember Pearson <br /> Conncihnember Cook <br /> Councilmember Elvig <br /> Councilmember Kurak <br /> Councilmember Strommen <br /> Councilmember Zimmeran <br /> <br />and the following voted against the same: <br /> <br /> none <br /> <br />and the following abstained: <br /> <br /> none <br /> <br /> <br />
