Utility costs within TIF District No. 5 will be paid through tax increment <br />and special assessments. Commercial site improvements and street and utility <br />construction within TIF District No. 2 will be paid through tax increment. <br /> <br />I. Relocation. <br /> <br /> The City anticipates that no relocation will be necessary but accepts its <br />responsibility for providing for relocation pursuant to Section 469.133 of the City <br />Development District Act. If relocation is necessary, provisions will be made in <br />accordance with Minnesota Statutes, Sections 117.50 through 117.56, inclusive. <br /> <br />J. Administration of Development District. <br /> <br /> Maintenance and operation of the public improvements will be the <br />responsibility of the Administrator of Development District No. 1. Each year the <br />Administrator will submit to the City Council the maintenance and operation <br />budget for the following year. The Administrator will administer the Development <br />District pursuant to the provisions of Section 469.131 of the City Development <br />District Act; provided, however, that such powers may only be exercised at the <br />direction of the City Council. No action taken by the Administrator shall be <br />effective without authorization by the City Council. <br /> <br /> The City does not anticipate the need to create an advisory board to advise <br />the City Council on the planning, construction or implementation of the activities <br />and improvements outlined in the Development District Program. <br /> <br />K. Rehabilitation. <br /> <br /> Owners of properties within Development District No. 1 may be encouraged <br />to rehabilitate their properties to conform to the applicable state and local codes <br />and ordinances, as well as any design standards implemented by the City. Owners <br />who purchase property within the Development District from the City may be <br />required to rehabilitate their properties as a condition of sale. The City may <br />provide such rehabilitation assistance as may be available from federal, state or <br />local sources. <br /> <br />L. Description of Development District. <br /> <br /> Lists of the properties included within Development District No. I were <br />attached to the Program documents adopted on August 27, 1985 and on June 30, <br />1986. A list of properties added to Development District No. 1 was included in two <br />modifications to the Development Program adopted March 29, 1988. These lists <br />are incorporated herein by reference. No additional property is being added to <br />Development District No. 1 as a result of this modification. A map of the <br />approximate boundaries of Development District No. 1 is included in Exhibit A <br />hereto. <br /> <br /> <br />
