o <br /> <br />o <br /> <br />o <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />PROPOSED FINDINGS OF FACT <br />CONDITIONAL USE PERMIT <br />GREEN VALLEY GREENHOUSE <br />03-32-25-41-0001 <br /> JULY 31, 1990 <br /> <br />That Mr. Wayne Davis, hereinafter referred to as "Applicant", has properly applied for a <br />conditional use permit to expand Green Valley Greenhouse. <br /> <br />That the Ramsey Planning and Zoning Commission conducted a public hearing pursuant to <br />Chapter 170.013D of the Ramsey City Code on July 3, 1990 and that said public hearing <br />was properly advertised and that the minutes of said public heating are hereby incorporated <br />as a part of these findings by reference. <br /> <br />That the subject property is located in the R-1 Rural Residential District and that the parcel <br />is 40 acres in size. The property surrounding the subject property is zoned R-1 Rural <br />Residential. <br /> <br />That the subject property is in the R-1 Rural Residential District and agricultural uses are <br />permitted uses in said zone with the exception of flower nurseries with buildings and the <br />subject property includes a flower nursery with a permanent building in addition to the <br />greenhouses which are considered temporary buildings. <br /> <br />That City Code Section 170.015G states that accessory buildings may be constructed in the <br />R- 1 Rural Residential District as a matter of right if they do not exceed 4800 square feet <br />plus the difference between the 864 square feet allowed for principal garages on the <br />property minus the actual size of the principal garage on the property and do not exceed 16 <br />feet in height. <br /> <br />That the existing permanent building accessory to the flower nursery is a pre-existing non- <br />conforming use that exceeds 4800 square feet and the Applicant is proposing to expand that <br />non-conforming use and structure, for which a conditional use permit is required according <br />to Section 170.015H of the Ramsey City Code. <br /> <br />That pursuant to MSA 16B.62, the building proposed to be expanded by the Applicant is <br />exempt from State and City building code requirements based upon the Applicant's <br />statement that there will be no retail activities carried on within said building. <br /> <br />That the Applicant is proposed to expand accessory building from 4,050 square feet to <br />8,910 square feet. The existing height is 26 feet and is not proposed to be expanded. <br /> <br />That the City has issued one other conditional use permit for a similar use in the Rural <br />Residential District. <br /> <br />That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br /> <br />That the proposed use will not substantially adversely impair the use, enjoyment or market <br />value of any surrounding property. <br /> <br />That the proposed use will be in accordance with the specific objectives of the <br />Comprehensive Plan, especially with 4 in 40 density zoning in effect. <br /> <br /> <br />
