14. <br /> <br />15. <br /> <br />16. <br /> <br />DEVELOPMENT A~REEMENT - ~OX RIDGE ESTATES <br /> <br />Requirements for Buildinq Permits. No building permit <br />for any lot in the Plat shall be issued until (a) <br />vehicular access to the lot is provided including the <br />installation of Class V material on all streets in the <br />Plat; (b) site plan approval is granted by the CITY and <br />any additional expense incurred in giving site plan <br />approval has been reimbursed to the CITY; (c) a <br />Certificate of Survey including that information required <br />by the CITY has been supplied to the Building Official, <br />and the financial guarantees required by paragraphs four <br />(4) and five (5) above have been satisfied. <br /> <br />Ve <br /> <br />PARK DEDICATION: <br /> <br />Land Dedication and Cash Payment. Park Dedication shall <br />be satisfied by the DEVELOPER depositing with the CITY <br />cash in the amount of Nineteen Thousand Three Hundred <br />Eighty-five and 00/100 Dollars ($19,385.00). The total <br />trail corridor park land dedication described below is <br />6.41 acres. Therefore the cash payment is determined as <br />58 lots x 500.00 per lot - 6.41 acres @ $1,500.00 per <br />acre = $19,385.00. <br /> <br />In addition, a trail corridor approximately 100 - 125 <br />feet in width shall be provided along Trott Brook as <br />shown on the Plat. In addition, a 75 foot wide trail <br />right-of-way shall be provided on the easterly side of <br />Lot 13, Block 1 of the Plat and then along the east side <br />of the loop road continuing south to the southwest corner <br />of the southeast of the Plat, and then east along the <br />south property line to Highway 47 right-of-way. <br /> <br />VI. <br /> <br />GENERAL <br /> <br />Tree Disease Prevention. The DEVELOPER shall prevent the <br />introduction and spread of tree disease into the residue <br />tree populations of the Plat and adjoining properties and <br />reduce the impacts of construction on the residual <br />property of the Plat and adjoining properties. The <br />DEVELOPER in order to accomplish this shall: <br /> <br />Install physical barriers such as snow fence or <br />string with ribbon, etc. around trees that are to <br />remain (the fencing will be at least ten feet (10') <br />from these remaining trees); <br /> <br />7 <br /> <br /> <br />
