YLITALO <br />ATTORNEY AT LAW <br /> <br />August 7, 1990 <br /> <br />City of Ramsey <br />15153 Nowthen Blvd. N.W. <br />Ramsey, MN 55303 <br /> <br />Attention: Ms. Sylvia Frolik <br /> Acting Community <br /> Development Director <br /> <br />IN RE: <br /> <br />Armstrong Addition <br />Minor Subdivision Matter <br />Our File No. B-4465 <br /> <br />Dear Ms. Frolik: <br /> <br /> We have been retained by Mr. Ray Wojcik, 2831 Cutters <br />Grove, Apt. 201, Anoka, Minnesota 55303, who is purchasing <br />property north of that owned by Fred Armstrong, with whom he <br />has initiated a minor subdivision proceeding. <br /> <br /> We are enclosing a copy of a letter from Mr. Merland <br />Otto of Hakanson Anderson Associates, Inc., dated May 29, <br />1990, addressed to the Ramsey Parks Commission, which properly <br />states the requirements in regard to park dedication for the <br />minor subdivision, which were approved by the Park and Recrea- <br />tion Commission at its meeting on June 13, 1990. <br /> <br /> The Planning and Zoning Commission, however, failed to <br />agree with the recommendations of the engineering firm, as <br />approved by the Park and Recreation Commission. Instead, the <br />Planning and Zoning Commission appeared to go beyond the <br />present minor subdivision plan; they requested park dedication <br />based upon the total acreage, including an outl~t ti~at <br />being subdivided at this time. <br /> <br /> The Planning and Zoning Commission has no authority to <br />require a land owner to develop and subdivide land beyond what <br />he desires to do at any particular time. That is a decision <br />for the land owner to make, when the time is right, and when <br />he can afford to do so. Of course, as stated by Mr. Otto, "Any <br />future resubdivision of the outlot will require additional <br />park dedication." <br /> <br /> Also, it certainly is inappropriate to require dedica- <br />tion of a 66 foot parcel along the west side of Lot 2, since <br />it would serve no useful purpose at the current time. At such <br />time as the land owner wishes to develop the outlot, it may <br /> <br /> <br />
