W~I shall renew each such bond after any such written notice, and failure to so renew the bond, or to provide substitute financial assurance, shall be an event of default of the obligations of WKMI and shall constitute grounds for immediate and automatic revocation of this permit. Said bond or substitute financial assurance .shall provide that if W~IMI refuses to perform all things required by the ordinances of the County for the operation and closure of the landfill as defined in the ordinances of the County, and the City is required to expend monies or labor or material to restore the landfill to the condi- tion and requirements required by =he' ordinances of the County, the obligor shall reimburse the City for any and all expenses incurred to remedy the failure of WMMI to comply with this Permit, and the obligor shall indemnify and save the City harmless from the losses, costs, and charges that may occur to the City because of any default by W/~MI. Prior to ex-pending monies, labor or material as above described as precedent to seeking indemnifi- cation from the obligor, the City shall give 90 days written notice to WMMI. (e) Confirmation of Indemnification. W}~I shall furnish to the City a letter confirming the Indemnification Agreement between the City, WM~I and Waste Management, Inc. dated December 12, 1984.. 34. Permit Period. This Permit sh~!! be effective only from and after the date on which the evidence of financial assurance required to ~-~e provided hereunder has been transmitted to, reviewed and accepted by the City. Thereafter, the Pe_--mit shall be in force and effect for the periods set forth previously herein, unless sooner revoked. Evidence of annual renewals of financial assurance: re.~uirad to be provided hereunder shall be submitted to the city annually within 15 days of their receipt by W%~[I. 25. Term. Nothing in ~his Permit shall authorize or pe_~it the conduct of active landfill operations on the property described on Exhibit A attached hereto after December 31, 1993 by or upon which date all active landfill operations on said proper~y will cease.
