PAUL, MN 55106 <br /> <br />PHONENO. 296-?523 FILENO. <br /> <br />I July 18, 1990 <br /> <br />Ms. Sylvia Frotik <br />City of Ramsey <br />15153 Nowthen Blvd. NW <br />Ramsey, MN 55303 <br /> <br />Dear Ms. Frolik: <br /> <br />RE: CHESTNUT POND ADDITION, WETLAND 2-116W, CITY OF RN4SEY, ANOKA <br /> COUNTY <br /> <br />With the assistance of intern Bob Effinger I have done a preliminary <br />review of the proposed Chestnut Pond Addition and have the following <br />comments: <br /> <br />1) <br /> <br />A portion of the waterfront lots 1 - 9 lie below the ordinary <br />high water elevation {OHW) of Department of Natural Resources <br />Protected Wetland 2-116W (see enclosed map). A DNR protected <br />waters permit would be required for any plans to alter the <br />wetland basin below the OHW {including the installation of <br />stormwater outfalls). Minnesota Rules, part 6115.0190, subpart <br />3, item B. prohibits the placement of fill below the OHW of a <br />DNR protected wetland to create upland areas for development. <br /> <br />2) <br /> <br />The wetland boundary designated on the map you sent may not <br />coincide with the OHW. The OHW should be determined in order <br />to determine setback distances and lot sizes. It can be <br />determined by DNR personnel upon request. <br /> <br />3) <br /> <br />Waterfront lots 1 - 7 do not meet the City of Ramsey minimum <br />lot size requirements and waterfront lots 1 - 5 may not meet <br />the required setback distance from the OHW {see setback <br />boundary on enclosed map). For sewered developments, the City <br />of Ramsey minimum structure setback distance is 50-feet from <br />the OHW and minimum lot sizes are 15,000 square feet {riparian <br />lots) and 10,000 square feet {non-riparian). Waterfront lots 8 <br />& 9 may not meet the lot size requirements depending on the <br />location of'the OHW. All non-riparian lots appear to meet size <br />requirements. <br /> <br />4) <br /> <br />Since no part of the project area lies in the designated <br />lO0-year floodplain, there appear to be no floodplain ordinance <br />concerns {see enclosed map). <br /> <br />AN EQUAL OPPORTUNITY EMPLOYER <br /> <br /> <br />
