Councilme~ber and moved for its adoption: introduced the following resolution AUTHORIZATION FOR ACQUISITION OF CERTAIN PERMANENT AND TEMPORARY EASEMENT BY USE OF MSA §117.011 AND §117.042 FOR UTILITY PURPOSES FOR IMPROVEMENT PROJECT 90-14. RESOLUTION #90-08- WHEREAS, The City proposes to construction a sanitary sewer and watermain improvement in the north half of section 26, township 32, range 25 and which project is known as City Improvement Project 90-14; WHEREAS, the improvement consists of constructing sanitary sewer and watermains to serve properties in the City which is necessary for the safety and convenience of the residents of the City; WHEREAS, peI-manent easements are required construction; and easements and temporary over certain lands for construction improvement WHEREAS, the City has the authority to acquire easements for said utilities by eminent domain pursuant to Minn. Stat. §117; and WHEREAS, the property owners from whom easements are required have been identified by the City as follows: Parcel Owner Lot 4, Block 4 Flintwood Hills Robert G. & Gayle D. Edberg Part of SE~ of Section 26, Township 32, Range 25 Estate of Daniel Laws Part of NE¼ of Section 26 Township 32, Range 25 Lou Hanus Part of NE~ of Section 26 Township 32, Range 25 Sidney Schomberg WHEREAS, the Council finds that it is in the City's best interests that the project proceed as quickly as possible and that therefore the City needs to acquire possession of the necessary parcels prior to filing an award by the Court Appointed Commissioners; and WHEREAS, the City has the right to acquire the easements prior to the filing of an award by the Court Appointed Commissioners, pursuant to Minn. Stat. §117.011 and §117.042; and
