Goodrich, City Attorney <br />SCORE Legislation/Curbslde Recycling Requirements <br />July 51, 1990 <br /> <br />At your Council meeting on July 24, 1990, I advised you that <br />would make inquiry with the Attorney General's office regarding the <br />legislation which seems to ~equire the City to provide curbside <br />recycling for all City residents. <br /> <br />I did speak with the Assistant Attorney General who represents the <br />State's office of Waste Management. The Attorney General referred <br />me to Barb Thomen of the Waste Management Office, County Planning <br />Assistance Unit. Ms. Thomen indicated that she understood our <br />concern and said that it would be acceptable to the State if we <br />worked out a system such as block by block bins in the less dense <br />areas of the City. However, Ms. Thomen said this would need to be <br />negotiated with the County, as the Counties are delegated the <br />recycling implementation responsibility. <br /> <br />I then called Carolyn Smith who is Anoka County's Solid Waste <br />Abatement Specialist. Ms. Thomen also spoke with Ms. Smith. <br />Through Ms. Smith, Anoka County takes the pomiticn that every <br />resident curbside pick-up is mandatory, notwithstanding what the <br />office of Waste Management says. Ms. Smith says that if we want <br />something different, we should lobby for new legislation. <br /> <br />At this point, if the Council is determined to avoid every resident <br />curbside recycling, I believe our alternatives are as follows: <br /> <br />Commence every resident curbside recycling and seek new <br />legislation which will explicitly permit something less <br />in less dense areas, and then adopt a new program <br />according to any n~w l~gislation adopted. <br /> <br />Negotiate with the Anoka County Commission to try and get <br />them to adopt a different policy and statute <br />interpretation. <br /> <br />Set up a recycling program which the City deems adequate <br />under the legislation. HOWEVER, if Anoka County doesn't <br />find this acceptable, which as o~ now seems likely, the <br />County can set up a curbside program in the City and/or <br />cut off our SCORE Legislation Funding. The City might <br />then want to seek Court interpretation of the statute <br />through legal action. <br /> <br />My recommendation is that the Council p~oceed on option no. 1 above <br />stated. <br /> <br />41 <br /> <br /> <br />
