Councilmember Elvig introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #03-11-295 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0657 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FROM STEVEN SCHWAAB TO <br />EXCEED SIZE RESTRICTIONS FOR A DETACHED ACCESSORY BUILDING ON <br />PROPERTY FROM 14,880-43,559 SQUARE FEET. <br /> <br /> WHEREAS, Steven Schwaab, hereinafter referred to as the "Applicant", has properly <br />applied for a Conditional Use Permit to exceed the size restrictions for detached accessory <br />buildings on properties from 14,880-43,559 square feet established in section 9.11.02 "Accessory <br />Uses" of City Code on the property generally known as 8732 168th Ave. NW and legally <br />described as follows: <br /> <br />Lot 7, Block 1, Autumn Heights, Anoka County, Minnesota <br /> <br />("Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That the Applicants appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on November 6, 2003, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated by reference. <br /> <br />2. That the Subject Property is zoned R-1 Residential - Rural Developing and is located outside <br /> the Metropolitan Urban Service Area (MUSA). <br /> <br />3. That the Subject Property is approximately 35,811 square feet in size. <br /> <br />4. That City Code restricts the Subject Property to a total of 1,488 square feet of accessory <br /> building space. <br /> <br />That the Applicants have a primary garage of 529 square feet; the new accessory building is <br />proposed to be 1,120 square feet in size; resulting in a total of 1,649 square feet of accessory <br />building on the Subject Property. <br /> <br />6. That the Applicants have stated that the reason for the excess size of the proposed building is <br /> to store private-use vehicles and other personal property. <br /> <br />7. That the Applicants have stated that the detached accessory building will be utilized for <br /> personal storage and will not be used to facilitate a business. <br /> <br />8. That the construction of the detached accessory building will comply with all applicable <br /> Uniform Building Codes. <br /> <br /> <br />
