W. <br />Ramsey, MN 55303 <br /> <br />RE: Requested hardship exception to development moratorium in the Hwy. 10 Corridor <br /> <br />Dear City Council; <br /> <br />As the owner of the property at 7129 Highway 10 N. W., Ramsey, MN. I respectfully request <br />that you grant an exception to Moratorium Ordinance 03-27 pursuant to the provisions provided <br />for under Section 4 of the ordinance. <br /> <br />Under Section 4 you have outlined the circumstances where strict adherence to the ordinance <br />would cause undue hardship and practical difficulty for the property owner and/or business <br />occupant of the subject property. Listed below I have outlined the specific provisions of Section <br />4 and the specific hardship or practical difficulty encountered in this situation. They are as <br />follows: <br /> <br />1. That there are special circumstances or conditions affecting said property such that the <br />strict application of the provisions of this Moratorium Ordinance would deprive the petitioner of <br />the reasonable use of petitioner's land. <br /> <br />The condition of the property requires updating for cosmetic and usability reasons. However the <br />costs associated with upgrading the property cannot be recovered with the current tenants of the <br />property. The current Tenants have indicated that they are unable to pay the current rent and <br />have requested a rent reduction because they are unable to generate business profits to cover <br />expenses. The rents that are being asked for this property are substantially below the norm for <br />the area and specifically are nearly half what rents are in retail complexes in the immediate <br />vicinity on Highway 10 in the City. After a seven month search for new Tenants, Ramsey <br />Spirits, LLC. has signed a lease to operate an MGM Wines & Spirits operation at the subject <br />property. MGM is requiting that a new Separated entrance, a new facade, and space for the <br />product coolers be added to the building. I am convinced though my efforts to keep this building <br />leased that the property must be improved in order to reach economic viability. - <br /> <br />2. That the exception is necessary for the preservation and enjoyment of a substantial <br />property right of the petitioner. : <br /> <br />This exception is necessary to generate the required cash flow to operate this property in an <br />economically feasible manner.
