RIVERBROOK <br /> DEVELOPMENT AGREEMENT <br />CITY OF RAMSEY, ANOKA COUNTY, MINNESOTA <br /> <br /> THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, <br />a municipal corporation under the laws'of the State of Minnesota (the "CITY"), and WAYNE <br />AND MARIAN MELOCHE, whose address is 17400 Erkium St N.W., Ramsey, MN 55303 <br />("t)EVELOPER"). <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, WAYNE AND MARIAN MELOCHE are the fee owners of the following <br />described property situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, <br />and legally described as follows: <br /> <br />All that part of Government Lot 4, Section 1, Township 32, Range 25, lying North of <br />Trott Brook running through said Government Lot 4 (consisting of approximately 30 <br />acres) and together with an easement for road purposes over and across the west 66 feet <br />of the east 250.81 feet of the Northwest Quarter of the Southwest Quarter of Section 1, <br />Township 32, Range 25, Anoka County, Minnesota, as measured at right angles to the <br />east line of said Northwest Quarter of the Southwest Quarter. <br /> <br />- or upon recording - <br /> <br />Lots 1 and 2, Block 1; Riverbrook, Anoka County, Minnesota <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, on December 9, 2003, pursuant to Resolution No. 03-12- , the CITY <br />approved the final plat of the Subject Property which plat is known as RIVERBROOK (the <br />"Plat"), which approval is contingent on certain requirements, including the DEVELOPER and <br />the CITY entering into this Agreement; and <br /> <br /> WHEREAS, the final plat for the Subject Property conforms to the sketch plan for <br />Riverbrook, approved by the CITY on November 6, 2003; and <br /> <br /> WHEREAS, the CITY requires certain improvements to be constructed within the Plat, <br />which improvements are defined as Stage I Improvements in the City Code; and <br /> Development Agreement/Riverbrook <br /> Page 1 of 8 <br /> <br /> <br />
