RIVERBROOK DEVELOPMENT AGREEMENT CITY OF RAMSEY, ANOKA COUNTY, MINNESOTA THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, a municipal corporation under the laws'of the State of Minnesota (the "CITY"), and WAYNE AND MARIAN MELOCHE, whose address is 17400 Erkium St N.W., Ramsey, MN 55303 ("t)EVELOPER"). WITNESSETH: WHEREAS, WAYNE AND MARIAN MELOCHE are the fee owners of the following described property situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described as follows: All that part of Government Lot 4, Section 1, Township 32, Range 25, lying North of Trott Brook running through said Government Lot 4 (consisting of approximately 30 acres) and together with an easement for road purposes over and across the west 66 feet of the east 250.81 feet of the Northwest Quarter of the Southwest Quarter of Section 1, Township 32, Range 25, Anoka County, Minnesota, as measured at right angles to the east line of said Northwest Quarter of the Southwest Quarter. - or upon recording - Lots 1 and 2, Block 1; Riverbrook, Anoka County, Minnesota (the "Subject Property"); and WHEREAS, on December 9, 2003, pursuant to Resolution No. 03-12- , the CITY approved the final plat of the Subject Property which plat is known as RIVERBROOK (the "Plat"), which approval is contingent on certain requirements, including the DEVELOPER and the CITY entering into this Agreement; and WHEREAS, the final plat for the Subject Property conforms to the sketch plan for Riverbrook, approved by the CITY on November 6, 2003; and WHEREAS, the CITY requires certain improvements to be constructed within the Plat, which improvements are defined as Stage I Improvements in the City Code; and Development Agreement/Riverbrook Page 1 of 8
