In addition, the DEVELOPER grants the CITY a license <br />to enter on each lot of the Plat in order to install the improvement described in this <br />paragraph if the same has not been previously constructed. <br /> SECTION III <br /> PERMITS AND OCCUPANCY <br /> <br />Requirements for Building and Occupancy Permits. No building permit for any lot in <br />the Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet of <br />the structure; (b) a Certificate of Survey that contains information required by the CITY <br />has been supplied to the City Building Official; (c) all the financial guarantees required <br />by the CITY have been satisfied; and (d) the Final Plat is recorded with Anoka County. <br />Approval of the building foundation requires a certificate of elevation signed by a <br />licensed (State of Minnesota), professional land surveyor, verifying that the elevation <br />complies with the approved grading plan for each lot. Foundation approvals will require a <br />certificate of elevation verifying that the actual elevation is in compliance with the <br />approved grading and drainage plan. The lowest floor elevation shall be at least 2 feet <br />above the 100 year elevation. No occupancy permit for any lot in the Plat shall be issued <br />until: (a) vehicular access to the lot is provided including the installation of at least one <br />layer of bituminous surfacing; (b) all utilities are in place, operational and accepted by <br />the CITY; (c) the City has been provided with a certificate of grading for any lot with a <br />slope flatter than 2%; and (d) boulevard sod and landscape tree, or escrow for same, have <br />been provided. <br /> <br />10. <br /> <br /> SECTION IV <br />PARK DEDICATION <br /> <br />Cash Contribution. The Plat is located in the Rogers Lake Recreation District. Park <br />dedication requirements shall be satisfied by a cash payment in the amount of One <br />Thousand Eight Hundred Dollars and no cents ($1,800.00) (1 lot x $1,800.00 per lot). <br />The existing homestead is exempt from the park dedication obligation. This payment <br />shall be made to the City prior to the release of the Final Plat for recording. <br /> <br /> SECTION V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />11. Trail Development and Fees. The City Council has enacted a trail development fee in the <br /> amount of Four Hundred Seventy Five Dollars and no cents ($475.00) per new lot created. <br /> Therefore, a payment in the amount of Four Hundred Seventy-Five Dollars and no cents <br /> ($475.00) (1 lot x $475.00/Iot) is due. The existing homestead is exempt from the Trail Fee <br /> obligation. This payment shall be made to the City prior to the release of the Final Plat for <br /> recording. <br /> <br />12.
