PARAGRAPH 3.12 <br />Add the following paragraph to the end of Paragraph 3.12: <br />3.12.11 All shop drawings for any architectural, structural, mechanical or electrical work must be <br />submitted to, and approved by, the Architect. The Contractor represents and warrants that all shop <br />drawings shall be prepared by persons and entities possessing expertise and experience in the trade <br />for which the shop drawing is prepared and, if required by the Architect or applicable law, by a <br />licensed engineer. <br />PARAGRAPH 3.13 <br />Add the following paragraphs to Paragraph 3.13: <br />3.13.2 Only materials and equipment which are to be used directly in the Work shall be brought to <br />and stored on the Project site by the Contractor. After equipment is no longer required for the Work, <br />it shall be promptly removed from the Project site. Protection of construction materials and <br />equipment stored at the Project site from weather, theft, damage and all other adversity is solely the <br />responsibility of the Contractor. <br />3.13.3 The Contractor and any entity for whom the Contractor is responsible shall not erect any sign <br />on the Project site without the prior written consent of the Owner, which may be withheld in the sole <br />discretion of the Owner. <br />3.13.4 Contractor shall ensure that the Work, at all times, is performed in a manner that affords <br />reasonable access, both vehicular and pedestrian, to the site of the Work and all adjacent areas. The <br />Work shall be performed, to the fullest extent reasonably possible, in such a manner that public areas <br />adjacent to the site of the Work shall be free from all debris, building materials and equipment likely <br />to cause hazardous conditions. Without limitation of any other provision of the Contract Documents, <br />Contractor shall use its best efforts to minimize any interference with the occupancy or beneficial use <br />of (1) any areas and buildings adjacent to the site of the Work or (2) the Building in the event of <br />partial occupancy, as more specifically described in Paragraph 9.9. <br />PARAGRAPH 7.2 <br />Add the following paragraph to the end of Paragraph 7.2: <br />7.2.2 Agreement on any Change Order shall constitute a fmal settlement of all matters relating to the <br />change in the Work which is the subject of the Change Order, including, but not limited to, all direct <br />and indirect costs associated with such change and any and all adjustments to the Contract Sum and <br />the construction schedule. In the event a Change Order increases the Contract Sum, Contractor shall <br />include the Work covered by such Change Orders in Applications for Payment as if such Work were <br />originally part of the Contract Documents. <br />PARAGRAPH 9.3 <br />Add the following clause to the end of Paragraph 9.3.1.: <br />.3 Each Application for Payment shall be accompanied by the following, all in form and <br />substance satisfactory to the Owner: <br />(1) a current Contractor's lien waiver and duly executed and acknowledged sworn <br />statement showing all Subcontractors and materialmen with whom the Contractor <br />has entered into subcontracts, the amount of each such subcontract, the amount <br />SUPPLEMENTARY CONDITIONS <br />00800-4 <br />
