PARAGRAPH 9.10 <br />Add the following language to the end of Paragraph 9.10.1: <br />All warranties and guarantee required under or pursuant to the Contract Documents shall be <br />assembled and delivered by the Contractor to the Architect as part of the final Application for <br />Payment. The fmal Certificate for Payment will not be issued by the Architect until all warranties <br />and guarantees have been received and accepted by the Owner. <br />PARAGRAPH 10.2 <br />Add the following language to the end of Paragraph 10.2.3: <br />The Contractor shall also be responsible, at the Contractor's sole cost and expense, for all measures <br />necessary to protect any property adjacent to the Project and improvements therein. Any damage to <br />such property or improvements shall be promptly repaired by the Contractor. <br />Add the following clause 10.2.4.1 to subparagraph 10.2.4: <br />10.2.4.1 When such use or storage of explosives or other hazardous materials or equipment or <br />unusual methods are necessary for execution of the work, the Contractor shall give the <br />Owner reasonable advance notice of their intended use. <br />Add the following paragraphs to the end of Paragraph 10.2: <br />10.2.9 When all or a portion of the work is suspended for any reason, the Contractor shall securely <br />fasten down all coverings and protect the Work, as necessary, from injury by any cause. <br />10.2.10 The Contractor shall promptly report in writing to the Owner and Architect all accidents <br />arising out of or in connection with the Work which cause death, personal injury, or property <br />damage, giving full details and statements of any witnesses. In addition, if death, serious personal <br />injuries, or serious property damages are caused, the accident shall be reported immediately by <br />telephone or messenger to the Owner and the Architect. <br />PARAGRAPH 11.1 <br />Add the following Paragraphs to the end of Paragraph 11.1.1: <br />11.1.1.9 Liability Insurance shall include all major divisions of coverage and be on a comprehensive <br />basis, including: <br />1. Premises Operations (including X-C/U as applicable). <br />2. Independent Contractor's Protective. <br />3. Products & Completed Operations. <br />4. Personal Injury Liability with Employment Exclusion deleted. <br />5. Contractual including specified provision for Contractor' s obligation under Paragraph 4.18. <br />6. Owned, non -owned and hired motor vehicles. <br />7. Broad Form Property Damage including Completed Operations. <br />8. Umbrella Excess Liability. <br />9. If the General Liability coverages are provided by a Commercial General Liability Policy on <br />a claims -made basis, the policy date or Retroactive Date shall predate the Contract; the <br />termination date of the policy or applicable extended reporting period shall be no earlier than <br />that termination date of overages required to be maintained after final payment, certified in <br />accordance with Paragraph 9.10.2. <br />10.
