.5 Every Bond under this Paragraph 11.4.1 must display the Surety's Bond Number. A rider <br />including the following provisions shall be attached to each Bond: <br />(1) Surety hereby agrees that it consents to and waives notice of any addition, alteration, <br />omission, change, or other modification of the Contractor Documents which, <br />singularly or in the Aggregate, does not exceed twenty-five percent (25%) of the <br />Contract Sum. Except as to increases in the Contractor Sum in excess of the <br />percentage set forth above in this Clause 11.4.1.5(1), any other addition, alteration, <br />change, extension of time, or other modification of the Contractor Documents, or a <br />forbearance on the part of either the Owner or the Contractor to the other, shall not <br />release the Surety of its obligations hereunder and notice to the Surety of such <br />matters is hereby waived. <br />(2) Surety further agrees that in event of any default by the Owner in the performance of <br />the Owner's obligations to the Contractor under the Contract, the Contractor or <br />Surety shall cause written notice of such default (specifying said default in detail) to <br />be given to the Owner, and the Owner shall have thirty (30) days from time after <br />receipt of such notice within which to cure such default, or such additional <br />reasonable period of time as may be required if the nature of such default is such <br />that it cannot be cured within thirty (30) days. Such Notice of Default shall be sent <br />by certified or registered U.S. Mail, return receipt required, first class postage <br />prepaid, to Lender and the Owner. <br />(3) Surety agrees that it is obligated under the bonds to any successor, grantee or <br />assignee of the Owner. <br />Add the following Paragraphs to Paragraph 11.4: <br />11.4.3 The Contractor shall keep the surety informed of the progress of the Work, and, where <br />necessary, obtain the surety's consent to, or waiver of: (1) notice of changes in the Work; (2) request <br />for reduction or release of retention; (3) request for final payment; and (4) any other materials <br />required by the surety. The Owner shall be notified by the Contractor, in writing, of all <br />communications with the surety. The Owner may, in the Owner's sole discretion, inform surety of <br />the progress of the Work and obtain consents as necessary to protect the Owner's rights, interest, <br />privileges and benefits under and pursuant to any bond issued in connection with the Work. <br />The following is a supplement to the General Conditions and Standard Form of Agreement between Owner <br />and Contractor (AIA Document A101) dated 2007. <br />Worker's Compensation - Requirement of M.S.A. § 176.182 <br />Contractor represents and warrants that it has, and will maintain during the performance of this agreement, <br />workers' compensation insurance coverage required pursuant to M.S. § 176.181, subd. 2, and that the <br />certificate of insurance or the written order of the Commissioner of Commerce permitting self insurance of <br />worker's compensation insurance coverage provided to City prior to execution of this agreement is current <br />and in force and effect. <br />Note: This provision is required pursuant to M.S.A. § 176.182 which prohibits a municipality from entering <br />into any contract for the doing of any public work before receiving from all other contracting parties <br />acceptable evidence of compliance with the Worker's Compensation Insurance Coverage requirement of <br />§ 176.181, subd. 2. <br />SUPPLEMENTARY CONDITIONS <br />00800-9 <br />
