35. 36. 37. 38. 39. statute, regulation, ordinance or permit condition imposed by lawful governmental authority and governing operations on the Site is grounds for revocation and termination of this CUP consistent with applicable law. The change, alteration or amendment of any such statute, regulation, ordinance or permit condition by any governmental authority other than the City shall not excuse WMMI from compliance with statutes, regula- tions ordinances or CUP conditions in effect on the date of the original issuance of this permit unless compliance is waived or excused by the City. Violation a Misdemeanor. Violation of any of the provisions of this CUP is declared to be a violation of the City 'of Ramsey in accordance with Section 250.1 of the Ramsey City code. Nonassignability of CUP. Any rights conferred on WMMI by this CUP are personal to WMMI. The City is issuing this CUP on the basis of the credit and reputation of WMMI. WM~I shall not assign or transfer this CUP without first obtaining approval of the City which may allow or disallow such transfer in its absolute and sole discretion. In the event of transfer, the CUP shall apply to WMMI's successors and assigns. In the event the City declines for any reason to allow the transfer of this CUP, WMMI shall either continue with tire processing operations in full compliance with the terms of this CUP or terminate waste tire processing opera- tions at its option. On-site Inspection. The City reserves the right to inspect the site for the purposes of examining and copying non- privileged records; conducting inspections, surveys, investi- gations, monitoring or sampling; and obtaining necessary information pertaining to the construction, operation and environmental effect of the waste tire processing facility. Inspections shall be conducted during normal business hours except in the event of an emergency. City personnel or agents performing the inspection will provide reasonable notice to WMMI personnel prior to the time of inspection. Reports. The permit holder shall report in a monthly report, the number of tons of yard waste received, the number of tons of composted material removed, landspread, or otherwise used, the number of tons of wood chip products used, removed form the site, and/or composted and weekly monitoring data as required in Section 22. Documents and Plans. Copies of all documents, plans, or other reports which are required to be supplied to the MPCA or Anoka County shall also be supplied concurrently to the City at no cost to the City. 7
