Term, This monthly tax escrow may be adjusted during the Term depending on the then
<br />annual property taxes and assessments levied on the Premises. Landlord shall notify
<br />Tenant in writing of the adjusted amount as necessary,
<br />4,2 Additional Rent Based Upon Reimbursement to Landlord. If Tenant
<br />shall fail to comply with or to perform any of this Lease's terms, conditions and
<br />covenants, Landlord may (but with no obligation to do so) carry out and perform such
<br />terms, conditions and covenants, at the Tenant's expense, which expense shall be payable
<br />by Tenant, as additional rent, upon the Landlord's demand, together with interest at the
<br />prime rate per annum of Wells Fargo Minneapolis (or its successor), plus two (2%)
<br />percent (the "Prime Rate"), which interest shall accrue from the date of Landlord's
<br />demand.
<br />4'.3 Additional Rent Based Upon Late Payment. If Tenant defaults, for
<br />more than ten (10) days in the payment of any monthly installment of fixed annual rent,
<br />additional rent or any of the sums required of Tenant under the Lease, or if Tenant, within
<br />ten (10) days after demand from Landlord, fails to reimburse Landlord for any expenses
<br />incurred by Landlord pursuant to the Lease, together with interest, then Tenant shall pay
<br />Landlord, as additional rent, a late charge of five (5%) percent of the rent or expense due
<br />and owing.
<br />5. Limitations on Use. Tenant shall use and occupy the Premises only as and for a
<br />licensed off -sale liquor store purposes and for all other purposes reasonably incidental thereto.
<br />Tenant shall not occupy nor use all or any part of the Premises nor permit or suffer the Premises
<br />to be occupied or used for any unlawful purpose.
<br />6. Maintenance.
<br />6.1 Tenant's Obligations. Tenant shall, at Tenant's own expense, maintain,
<br />keep in good condition, repair and make replacements, foreseen and unforeseen, ordinary
<br />and extraordinary, structural and non-structural, to the exterior of the building on the
<br />Premises (including, but not limited to the roof, roof system, windows, doors, foundation
<br />and structural soundness of the exterior walls, and the underground utility and sewer
<br />pipes) and interior of the building on the Premises (including, but not limited to, the
<br />plumbing system, the sprinkler system, if any, the heating system, the air conditioning
<br />system, if any, the electric system and any other system of the building on the Premises),
<br />and the driveways, parking areas, shrubbery and lawn, on the Premises, and upon this
<br />Lease's expiration or termination, deliver the Premises in good order and condition and
<br />broom clean.
<br />6.2 Damage Caused by Tenant. Notwithstanding any contrary provisions set
<br />forth in this Lease, Tenant shall promptly repair or replace to its former condition, any
<br />damage to the Premises, including, but not limited to, the building or its systems, or the
<br />improvements caused by Tenant or a "Tenant Representative" (as defined below), or
<br />otherwise cause by Tenant's default under this Lease, as required by Landlord, at
<br />Tenant's own expense. The term "Tenant Representative" shall mean any shareholder,
