3, Article X, Subdivision 1 is amended to read as follows; <br />Subdivision 1. Each member agrees to be bound by the terms of this agreement <br />until January 1, 2015, and it may be continued thereafter at the option of the <br />Parties. <br />4. Article X, Subdivision 2 of the Joint Powers Agreement is amended to read as <br />follows: <br />Subdivision 2. This agreement may be terminated prior to January 1, 2015, by <br />the unanimous consent of the members or if for any reason the Commission is <br />reduced to less than three members. If the agreement is to be terminated, a notice <br />of the intent to dissolve the Commission shall be sent to the Board of Water and <br />Soil Resources and to Anoka County at least 90 days prior to the date of <br />dissolution, <br />5. Except as modified herein, the Joint Powers Agreement shall remain in full force <br />and effect. <br />6. This Agreement shall be effective upon ratification by the City Councils of all of <br />the Parties and the execution of this Agreement by all Parties. Upon receipt of certified copies of <br />resolutions approving the Amendment to this Agreement and executed copies of the Amendment <br />by all of the Parties, the Secretary of the Commission shall supply to the City Clerk of each of <br />the Parties a copy of the resolutions and of the signed agreement. <br />7. This Amendment may be executed in several counterparts, each of which, when <br />assembled to include an original signature for each of the Parties, will constitute a complete and <br />fully executed original. <br />IN WITNESS WHEREOF, the undersigned, as duly authorized by action of their City <br />Council, have caused this Agreement to be executed in accordance with the Authority of Minn. <br />Stats. §§ 103B.211 and 471.59., <br />Dated: /7 - -i -0 <br />2 <br />CITY OF ANDOVER <br />By: ''.
