October 8, 2013 <br />Mr. Todd Haas, Chair <br />Lower Rum River Watershed Management Organization <br />Andover City hall <br />1685 Crosstown Boulevard NW <br />Andover, MN 55304 <br />Dear Mr. Haas: <br />As the City of Ramsey representative to the Lower Rum River Watershed Management Organization <br />( LRRWMO), I am proposing the attached amendments to the LRRWMO Joint Powers Agreement. <br />Below is a summary of the proposed changes that we would like considered at the LRRWMO meeting. <br />• Paragraph #3 adds a subdivision to Article V explaining how the votes are to be counted. <br />Subparagraph "a" is for capital improvement projects and subparagraph "b" is for basically <br />everything else. <br />• Paragraph #4 cleans up contradictory language in Article VII. <br />• Paragraph #5 deletes language that isn't necessary and clears up confusion. It referred to <br />subsections that do not exist and stated that absent a negotiated agreement on improvements, <br />such improvements are to be constructed per Minn. Stat. § 103B.251, which is a levy statute that, <br />by itself, does not answer the question of who pays how much. It also contradicts subdivision 5, <br />which said that if it isn't negotiated, it is to be arbitrated. <br />• Paragraph #5 of the amendment deletes that subdivision 5 mentioned above.
