'r <br /> <br />Councilmember DeLuca introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION ~90-02-48 <br /> <br />RESOLUTION STATING CITY'S POSITION WITH RESPECT TO CANDIDATE <br />LANDFILL SITE BUFFERS <br /> <br /> WHEREAS, candidate landfill Site P is situated within the City and has nearby <br />residential development to the northwest and southeast of the site; and <br /> <br /> WHEREAS, landfill operations within 5000' of a runway used by piston aircraft are <br />considered to be incompatible; and <br /> <br /> WHEREAS, landfill operations and related landfill activities 'have the potential to <br />adversely impact surrounding land uses; and <br /> <br /> WHEREAS, the intent of Chapter 325 laws of 1989 and MSS 473.823, Subd. 3 is m <br />ensure that buffer areas, at a minimum, protect surrounding land uses from adverse or <br />incompatible impacts due to landfill operation and related activities; and <br /> <br /> WHEREAS, landfill related activities are herein defined to include but are not limited to <br />long-term excavation activities, placement of waste fill, stockpiling of materials for liner, interim <br />and cover requirements, borrow operations for liner, interim and cover materials, soil modification <br />operations, and equipment storage; and <br /> <br /> WHEREAS, the Metropolitan Council is in the process of defining the term "buffer <br />area" and establishing criteria and policies for buffer areas. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, AS FOLLOWS: <br /> <br />That the City state its position to the Metropolitan council and to the legislature clearly <br />supporting the need for buffer areas which separate and protect surrounding land uses from <br />landfill operations and related landfill activities. <br /> <br />That the City staff is directed to work with Metropolitan council, other regulatory agencies <br />and the legislature to promote a policy which will be consistent with legislative intent in <br />Chapter 325, laws of 1989 and MSS 473.823 subd. 3. <br /> <br />That the City oppose usurpation of reasonable control over landfill activities through zoning <br />overrides by other governmental jurisdictions or private entities <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Pearson and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Reimann <br />Councilmember DeLuca <br />Councilmember Pearson <br />Councilmember Cich <br />Councilmember Peterson <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br /> <br />
