I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />! <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I n/ <br /> <br />DEVELOPMENT AGREEMENT - NORTHFORK PARK ADDITION <br /> <br />WHEREAS, no expenditure of CITY funds, will be made until the <br /> <br />City Code escrow requirements have been fulfilled by DEVELOPER. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />mw <br /> <br />DEDICATION OF PARKs EASEMENTS AND RESTORATION <br /> <br />Restoration. DEVELOPER shall restore all disturbed <br />street right-of-way areas, including ditches, grading, <br />backslopes and established turf by seeding the ditch <br />areas. Said restoration to include such additional items <br />as the City Engineer may direct. <br /> <br />II. <br /> <br />PRIVATE OPEN SPACE <br /> <br />Private Open Space. Outlot A of the Plat shall be <br />conveyed to North Fork Homeowners Association, Inc. by <br />DEVELOPER. It is the intention of said Homeowners <br />Association to use this Outlot for permanent recreation <br />and open space purposes as private property for use by <br />its Association members only. This Outlot is therefore <br />not developable, with the exception that structures which <br />are consistent with and incidental to recreational/open <br />space purposes shall be permitted upon proper application <br />to and approval by the CITY. In order to insure the <br />permanent recreational/open space status of Outlot A of <br />the Plat, the DEVELOPER, at the time of conveyance of <br />said Outlot to North Fork Homeowners Association, Inc., <br />shall cause the instrument of conveyance to contain a <br />restrictive covenant in form acceptable to the CITY and <br />FHA, if applicable, permanently restricting the use of <br />said Outlot to private recreational/open space purposes. <br /> <br />III · <br /> <br />PERMITS <br /> <br />Permits. The DEVELOPER shall provide to the CITY a copy <br />of all required land development/environmental permit(s) <br />and permit requirements from all other governmental <br />agencies including U.S Army Corp of Engineers and <br />Department of Natural Resources. <br /> <br />2 <br /> <br /> <br />
