I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />i <br />I <br />i <br />I <br />I <br />I <br /> <br />3.0 REVIEW OF OVERALL SITE SUITABILITY <br /> <br />The suitability of a site to be utilized for a solid waste management disposal facility is <br />addressed by Minnesota Rules 7035.2565 and 7035.2815. These rules state the following: <br /> <br />Minnesota Rule 7035.2565 GROUND WATER QUALITY, SURFACE WATER <br />QUALITY, AND AIR QUALITY AND SOIL PROTECTION <br /> <br />Subpart 1. Duty to protect water. Solid waste management facilities must <br />be located, designed, constructed, and 'operated to contain sediment, solid <br />waste, and leachate and to prevent pollution of ground water and surface <br />water... <br /> <br />Subpart 4. Soil protection. Solid waste management facilities must be <br />located, designed, constructed, and operated to minimize the contamination <br />of soils from solid waste. <br /> <br />Minnesota Rule 7035.2815 MIXED MUNICIPAL SOLID WASTE LAND DISPOSAL <br />FACILITIES <br /> <br />Subpart 2. Location. <br /> <br />A. A facility must be located only in area where: <br /> <br />(1) <br /> <br />the topography, geology and ground water conditions allow <br />the facility to be designed, operated, constructed, and <br />maintained in a manner that minimizes environmental <br />impacts... <br /> <br />C. A land disposal facility must not be located on a site where: <br /> <br />(2) there are other unstable soil or bedrock conditions that may <br /> cause failures of the leachate management system; or <br /> <br />(3) <br /> <br />an airport runway used or scheduled for use by turbojet <br />aircraft is located within 10,000 feet of the waste boundary, <br />or an airport runway used or scheduled for use by piston° <br />type aircraft only is located within 5000 feet of the waste <br />boundary, unless approval is obtained from the Federal <br />Aviation Administration. <br /> <br />16 <br /> <br /> <br />
