WMMI shall require removal of all plastic bags <br />from the waste prior to placing in windrows. The yard waste <br />shall be monitored weekly April 1st through October 31st to <br />facilitate optimum decomposition and to minimize odors and to <br />assure moisture, oxygen, temperature and pH. <br /> <br />Operation. WMMI shall maintain levels of oxygen, moisture <br />and temperature. A windrow machine shall be used, if <br />necessary, April through October to rotate composting material <br />to maintain adequate oxygen, temperature and moisture control <br />so as to minimize odors and to assure rapid decomposition. <br /> <br />Curinq Piles. The curing piles shall be so maintained or <br />screened that the piles cannot be seen from public roadways <br />or residential areas. <br /> <br />Odor. Upon any legitimate and substantial complaint of odors <br />received by the City, WMMI shall be notified and will have 48 <br />hours to satisfactorily remedy the problem. If the odor <br />problem cannot be resolved within 48 hours, all compost <br />materials creating the odor problem shall be removed from the <br />site and lawfully disposed of. <br /> <br />Closure Due to CUP Revocation, Other Circumstances. In the <br />event this CUP is revoked or WMMI closes operation of the <br />compost facility for any reason, including but without <br />limitation, order of the court or other agency of competent <br />jurisdiction, bankruptcy, insolvency, or abandonment, WMMI <br />shall immediately proceed to remove all yard waste, compost, <br />tree prunings, chips and all other materials from the site. <br />In the event WMMI fails to comply with the terms of this CUP, <br />the City may, upon 30 days' written notice to WM/~I enter into <br />the property and perform all such obligations, the costs of <br />which shall be borne by WMMI or, in default thereof, by its <br />surety. <br /> <br />Building Permits. No construction of any structures shall <br />commence prior to the issuance of a building permit by the <br />city Building official. <br /> <br />Scope and Conduct of Operations. The operations permitted by <br />this CUP may be performed on the Subject Property in confor- <br />mance with existing statutory and regulatory authority and <br />requirements of the City, Anoka County, Minnesota ("County"), <br />and the Minnesota Pollution Control Agency ("MPCA"). <br /> <br /> <br />
