I I I I I I I I I I I I I i I I I I 21. 22. 23. 24. 25. 26. 27° Monitoring. WMMI shall require removal of all plastic bags from the waste prior to placing in windrows. The yard waste shall be monitored weekly April 1st through October 31st to facilitate optimum decomposition and to minimize odors and to assure moisture, oxygen, temperature and pH. Operation. WMMI shall maintain levels of oxygen, moisture and temperature. A windrow machine shall be used, if necessary, April through October to rotate composting material to maintain adequate oxygen, temperature and moisture control so as to minimize odors and to assure rapid decomposition. Curinq Piles. The curing piles shall be so maintained or screened that the piles cannot be seen from public roadways or residential areas. Odor. Upon any legitimate and substantial complaint of odors received by the City, WMMI shall be notified and will have 48 hours to satisfactorily remedy the problem. If the odor problem cannot be resolved within 48 hours, all compost materials creating the odor problem shall be removed from the site and lawfully disposed of. Closure Due to CUP Revocation, Other Circumstances. In the event this CUP is revoked or WMMI closes operation of the compost facility for any reason, including but without limitation, order of the court or other agency of competent jurisdiction, bankruptcy, insolvency, or abandonment, WMMI shall immediately proceed to remove all yard waste, compost, tree prunings, chips and all other materials from the site. In the event WMMI fails to comply with the terms of this CUP, the City may, upon 30 days' written notice to WM/~I enter into the property and perform all such obligations, the costs of which shall be borne by WMMI or, in default thereof, by its surety. Building Permits. No construction of any structures shall commence prior to the issuance of a building permit by the city Building official. Scope and Conduct of Operations. The operations permitted by this CUP may be performed on the Subject Property in confor- mance with existing statutory and regulatory authority and requirements of the City, Anoka County, Minnesota ("County"), and the Minnesota Pollution Control Agency ("MPCA").
