I I I I I ORDINANCE //90-5 CITY OF RAMSEY ANOKA COUNTY STATE OF MINNESOTA AMENDMENT TO CHAPTER 170.01 OF THE RAMSEY CITY CODE WItlCH CHAPTER IS KNOWN AS THE "RAMSEY ZONING CHAPTER". AN ORDINANCE AMENt~NG-CHAPTER 170.01 BY THE ADDITION OF SECTION 170.016 WHICH_SECTION SHALL BE E,~bT!TLED "SOLID WASTE LANDFILL ORDINANCE". The City of Ramsey Ordains: SECTION 1. SUMMARY The following official summary of Ordinance ~90-5 has been approved by the City Council of the City of Ramsey as clearly informing the public of the-lntent and effect of the ordinance: It is the intent and effect of Ordinance t$90-5 to adopt certain provisions and conditions regarding the construction, operation, inspection, monitoring and maintenance of solid wasm disposal facilities within the City, provide for usable land after closure, to require buffer areas and to set time limitations for the period of operation. A printed copy of Ordinance #90-5 is available for inspection by any person at the Ra.msey Municipal Center. This Ordinance becomes effective upon its passage and thirty (30) days after publication according · .-. ' to law. :. SECTION 2. AMENDMENT .1':; PURPOSE AND POLICY It has been determined that improper waste storage, collection, transportation and disposal endanger the public health, safety and weffare, create public nuisances, result in scenic blight and adversely affect land values. Since this type of land use must meet or exceed the rules and standards established by the Minnesota Pollution Control Agency (MPCA), those same rules and standards must be met before a condition~ use permit may be considered by the City Council. Additionally, performance standards must be met to assure that all conditional use permit requests will be reviewed using criteria that will prohibit land uses that endanger the public health, safety and welfare, create public nuisances, result in scenic blight or adversely affect land values, or create land use confficts due to landfill operations and landfill related activities. 2. SCOPE In addition to the criteria outlined in Chapter 170.013D of the Ramsey City Code pertaining to conditional use permits, these are rules and standards that regulate the issuance of conditional use permits for storage, collection, transportation, treatment, utilization, processing, transfer, intermediate disposal, and f'mal disposal of solid waste' or processed waste product by any, person and the issuing of conditional use permits for the construction and operation of'soI~t waste disposal sites and facilities for the protection of the environment in keeping with Minnesota Statutes, Chapters 115, 116, 400 and 473D.
